From my experience, DAoC had the best PvP untill Mythics released ToA. After that, I got turned onto WoW and to much disappointment, Blizzard's PvP turned out to be quite poor too. Don't get me wrong, I got plenty of enjoyment out of that game also but underneath it's mechanics, it's not about who has the most skill, it's about who has the best gear > best guild > time played… and to me, that’s just not what PvP is about.
In my opinion, gear is what ruined both these lead games’s PvP systems. Again, don’t get me wrong, I enjoy gearing up a leet char as much as the next but I don’t think that in anyway it yields to the success of an MMO’s PvP gameplay.
Now I know GW is not considered an MMO and I definitely agree. It’s more of an ORPG and I think the official site even puts a “C” on the front and call it a “Competitive Online Role Playing Game.” Either way, NCSoft seems to really grasp the concept of quality MMO PvP. The game is obviously intended to revolve around skill and not gear.
I haven’t been playing GW for too long but from my experience, the PvP fundamentals are pretty well tuned. Just earlier I found on this site that both DaoC and GW tied for 2nd place on an article/poll for best PvP game (http://www.mmorpg.com/showFeature.cfm/loadFeature/388/page/5/from/). Does anyone have any comments on GW’s PvP? I haven’t had as much exposure to it as I’d like.

you forgot on Lineage 2 sure the grinding is boring, but it's pure pvp
DAoC is great, but unfortunately) I tried it after 1 year in L2 so I was missing ffa pvp which I got used to (got bored with l2 grinding though). I'd say, that the best pvp game at the moment is EVE, at least for me, in L2 anyone could kill you, but when you were with 100 people around you (strangers), you weren't feeling threaten and could grind alongside with them (of course you had to be cautious but I usually felt safe even when I was alone, of course conflicts were there all the time), where in EVE, everyone else except your allies is a threat... the sheer feeling of danger everytime you venture alone or even moving in small group is just priceless for me the combat is great too, very very tactical, not just hack&slash (good change)
so ya, at the moment, EVE's getting my vote 1 year ago, it'd be surely Lineage2 and DAoC
It's tactical as hell, and there's a real sense of loss when you get blown up.
Now with 57.3% more flames!
WoW's PvP system was the reason I left that steamer on the curb.
DAoC had a well defined and organized PvP system, and in the end that's what the vast majority of players want from a MMO.

GuildWars has and excellently balanced PvP system. It is not perfect, but player skill does play a significant role.
EvE suffers from the whole 'gear' issue which the OP mentions, so I don't think it is a great contender in terms of PvP balance.
My personal favourite, of course, has to be DarkSpace...
