What will happen to you if you leak beta info

I mean if you make a video and post it on the website like Youtube for example.
Can Mythic trace IP and sue you?

ps. I don't have any videos. It is just a question.

No unless Youtube gave them the IP. Even then you could upload it remotely.

If they do catch you the only thing they would do is likely ban you from any future MMOs they make and/or future betas for EA.

Even if youtube or traces the I.P. somebody could still use a proxy to disguise their real location.

well i dunno, but have you read the licens agreement before going into beta. YOU AREN'T ALLOWED to give any infos about EA Mythic beta programme. Don't be surprised if you'll need a lawyer soon!

Get a grip, you think they would waste thousands of pounds on court time and lawyers for a few video leaks?

  • ElgarethElgareth Member Posts: 588

Yeah well, it obviously isn't allowed, and you can expect that they do find out where that came from and thus being banned from the Beta and WAR, and maybe all EA Mythic Games.

However, I doubt that they'll sue you, even though they could, and it would be a rather fast trial, since you obviously broke a contract you agreed to.

Not to forget that the Video would be banned from Youtube within an hour or so, so it isn't worth it. (As much as I'd like to see some long Beta Gameplay ^_^)

Nothing for the most part. If you are dumb enough to put up your real name and home address Mythic might reach out and arse bang you with their army of lawyers.

The worst that would happen if you posted something anonymously on YouTube is that EA/Mythic would request that YouTube remove it and more then likely they'll comply. Yet if Mythic demands your ip and other private info there will more then likely be a big court case around it because YouTube does not want to seem a like push over when it comes to giving out private information unless a real crime has been committed like someone filming a murder or rape or something equally as heinous. So chances are EA and Mythic won't bother wasting extra cash on trying to find a person who leaks beta video but they will request that YouTube remove the video for sure.

Games I've played/tried out:WAR, LOTRO, Tabula Rasa, AoC, EQ1, EQ2, WoW, Vangaurd, FFXI, D&DO, Lineage 2, Saga Of Ryzom, EvE Online, DAoC, Guild Wars,Star Wars Galaxies, Hell Gate London, Auto Assault, Grando Espada ( AKA SoTNW ), Archlord, CoV/H, Star Trek Online, APB, Champions Online, FFXIV, Rift Online, GW2.

Depends if a virtual NDA that he did not sign will hold up in court under scrutiny or not. Also if he were under the age of 18 he'd pretty much be immune to it because minors aren't allowed to sign legal contracts of any kind without their parent's consent.

If they can not pin down Gold farmers in games what chance do they have of pinning you to an IP. None at all because of roaming IP's. Why would you want to show off that your in a beta of any game. Where I come from that's called swinging your dick.

The company who allow you to beta are trusting your honesty after signing their NDA, if you beark it you are a fool and I personally would like to see a registar so that they could sue people who do break them. Most of the people I have spoken to in beta who break it do not care and do not even report bugs. This is why games are hitting the streets in such a poor state. Lots of people applying for beta have no intention of bug reporting they just want the opportunity to play the game before they buy it. The prople with this it that many people give false information and bad press because they expect the game to be finished. When in fact it is far from complete, if you are one of these then do us all a favor and stay away.

WTF anyone would want to put footage of a beta game on tub for is beyond me, apart from like I said above to show off, put ya DICK away and use the time to bug report or go play wow or something.....

ROFL I just spotted OP's name think that just about says it all, I would put money on it you are deffo a YANK.

I was under the impression that you can test this product when they decide to release a ten day trail, not to take the Piss like you clearly have confirmed, no one asked you to test the game as an unpaid tester, and you took that choice. They did not hold a gun to your head making you apply to test it.

You agreed to observe the NDA and apply your self to test said game. Clearly you are abusing this position you agreed to help test and are there for one of the many people who abuses this opportunity to try and help the developers who are trying to make a product for the masses.  Clearly your attitude is that of many, you are only concerned about your needs. I believe it is people with your typical American attitude like you have to god given right to test to see if you want to invest in this product.

Clearly you have no intention of helping and would complain loudly if there was just a minor issue, we do not need people like you testing products. You hit the nail on the head when you comfirmed you are the JERK.  Nice one pal.

I'd say the NDA itself is illegal.

It's free speech censorship at its worst.

Everyone should sue the MMO companies NOW !

I find it funny that some people in this thread think the NDA is actually a legal document. In the USA, it definitely isn't. In order for a document to be legal, both sides must receive some material benefit from signing it. "We let you play our game lol" doesn't count, sorry. There is a minimum wage law, according to which they must provide you with at least $5.15 an hour. If they do not do this, part of the contract is not legal. In turn, the entire contract is not legal because you can't agree to part of a contract.

However, yes, they can sue you. Anyone can sue you at any time for any reason. That's the way the system works. But hey wouldn't - it's expensive. They would get absolutely nothing out of taking you to court. If, however, you get sued, contrary to the first reply, you wouldn't even need a lawyer. This case is so simple that you could get by on your own by spending a couple of days on a law site.

Also, I don't see how they could find out that you are the one that posted the video on youtube unless you left your name visible. To be safe, you could always use a proxy like anonym.to.

That said, I personally wouldn't do it. And I doubt the OP is actually in the beta.

ps. I don't have any videos. It is just a question.

All EA and War ToA state nothing about Release Beta information or any information to begin with... if anyhting as a company they would hope players would release videos and other info to get the hip up.

And no laws prohibt any indivual to release video footage of a electrace video game.... the only way they could mabye MAYBE sue you was if the game was not lisenced to you....... its really cofussing but let me put it for you in this way.... you liseces games like WOW and other things.   That gives the creators/GM the right to make you stop playing.  But like I said before no where in the ToA(terms of Agreement) does it state you cant.  Since it is your data too.... its hard to explain... GO TO LAW SCHOOL AND START PROGRAMING :)

Umm you do know that it isn't a Work Contract right? It's an Agreement Contract, saying nothing but "You test our game, but aren't allowed to tell anyone about it.", if he agrees, so be it.

Even a Contract of: "You give me 1.000.000$ so that I allow you to work for me" would be legal. Since he has to agree to the Contract prior to playing the game, he will get Problems. (And the "I didn't sign it, it was someone else who entered my Info" doesn't count when he plays the game, since you Probably have to agree again everytime you log in.)

This topic is stupid -- Know can mythic stop you from leaking info -- for example I play WAR beta, go to work, tell the people there about it... lol.

Or make a video, copy it to a dvd, then download it on a internet site on a different pc, like a college or library pc... or internet cafe... geese you people are silly.

What I think is funny is when people who are not lawyers give legal advice on mmo websites.  Most of the time, any "punishement" is described in a NDA.  If you are in a beta, you might actually want to ready it.  Typically it means you are banned from beta and sometimes from the finished product (although this can be hard to enforce when the game goes live).  You will certainly be blacklisted from any future betas.

You should consult a lawyer for advice if you are really worried.  The legality of the NDA aside, EA has enough money to make your life hell and drive you into bankruptcy if it wanted to even if there are no legal victories for them.

And yes it is very easy to get your IP.  When you log into the game, they log your IP.  If you make a video, then if there are any other players on your screen or tell-tale signs of way of them finding you out they will.  This is in addition to the fact that most places, when requested, will hand over your IP.  So the chances of you getting away with it are very minimal.

No, sorry. What you sign when you apply for Beta is not a real NDA, or it is NDA but not legally binding because it doesn't meet the requirements of NDA. In court this "NDA" would be as valuable as toiletpaper.

Lets have a contest here, whoever finds a document of a game company sueing a beta tester (a tester that didn't receive any compensation for testing it, like money), gets a cookie.

I don't actually have a cookie, but you wont find such a document either so it's all good

You'd think it would be banned from Youtube, but look at this rather old video from an AoC beta leak.  It's still there, and has been there for months.

LOL.  You can't get sued for breaking a TOS.  The worst they could do is ban you.
