Anyone with half a brain would simply read the agreement they clicked "I agree" to in order to enter beta to learn the details of what would happen if you broke that service agreement. If you're thinking about it, I'd recommend against it because A) no one cares people who leak info about games during beta are usually assumed to be lying and C) it would be a juvenile, childish thing to do.
I find it funny that some people in this thread think the NDA is actually a legal document. In the USA, it definitely isn't. In order for a document to be legal, both sides must receive some material benefit from signing it. "We let you play our game lol" doesn't count, sorry. There is a minimum wage law, according to which they must provide you with at least $5.15 an hour. If they do not do this, part of the contract is not legal. In turn, the entire contract is not legal because you can't agree to part of a contract. However, yes, they can sue you. Anyone can sue you at any time for any reason. That's the way the system works. But hey wouldn't - it's expensive. They would get absolutely nothing out of taking you to court. If, however, you get sued, contrary to the first reply, you wouldn't even need a lawyer. This case is so simple that you could get by on your own by spending a couple of days on a law site. Also, I don't see how they could find out that you are the one that posted the video on youtube unless you left your name visible. To be safe, you could always use a proxy like anonym.to. That said, I personally wouldn't do it. And I doubt the OP is actually in the beta.
fixy55 please do not post anything concerning law, its aparent that you do not know anything about even the basics of contract law and you have confused a working contract iwth a NDA, they're not hiring you they're granting you a license with the NDA incorporated as part of it. a license is permission to use the companies property (in this case the software and hardware servers) and they attached conditions, the condition that you don't breach the NDA and tell people. a contract is merely a bargained for exchange, the NDA can be enforced through contract law..the exchange is simple, you get to play the game in return for reporting bugs..it doesn't mean money is exchanged in fact you don't need money in a contract just an agreement to perform and consideration, here consideration is allowing you free access to the game, its very simple and if you went to lawschool or worked for a lawyer (and watching tv shows don't count) then you'd know how wrong you are.
the NDA is enforceable, you will end up with an injunction from the court and a cease and desist order. NDA's merely prevent you from disclosing informaiton, and gives the company the power to enforce through injunctions. Breaching a NDA will not cost you money, especially in this case because there was no money invovled so don't worry about getting sued. One reason for this is that they have to prove special damages before suing for damages and a video posted on utube will be extremely hard to prove damages to the company, so its not worth it, they simply ban you from the beta.
And NO nobody can sue you for any reason, thats the asinine presumption the amercian general public. oh sure you can sue and assert a claim, but there is a nice little motion we lawyers can file that is called summary judgment, and the more favorite "failure ot state a claim upon which relief can be granted'. Further, not only can we get the suit thrown out, but we can file ofr rule 11 friviolous litlgation sanctions which means YOU pay us for our wasted time

My guess if they find out you did it, they would kick you out and you wouldn't be invited back to beta any other games for them.
