Nyast, it's useless to attempt logically thinking, common sense or simply using facts with the mentality of some of these posters. Just like Farceland/NPFleece themselves, they consider the actions of the sleazy company Farceland/NPFleece to be simply of no harm to anyone except themselves because their slimy manipulations didnt work.
As of 06/03/08 -- the game is still experiencing the same problems it had well before release of the "SOG that is not DNL that really was DNL all along". Easily validated by posts on their own forums (of which they even tried to hide that from the general public due to the abysmal state of the game. They wanted people to sign on but didnt want them to know just how sloppy and unplayable this game really is. )
They have blamed _Pix_ and now have even attempted to place blame on Snailgames for their troubles. It's everybody else BUT Farceland according to them. (see the press release wherein Farceland attempts to bring Snailgames into the copyright infringement fiasco they created in a court of law.)
The saddest and most hilarious at the same time is that they STILLattempt to throw off this mess they themselves created and continue to make fools of themselves in the mmo industry.
I would just note that in the website of VWORLD, Pix is using the DarkAndLight to publicize his engine: there are screens of the game, written description, and so on. At the same time, Pix issues a lawsuit against Farlan for having stolen the engine and damaged his reputation (!!!). In other words, Farlan is an enemy when it comes to licensing his engine, but it's a good friend when it comes to exhalt the possibilities of his engine. Anything that makes money, of course, is welcome, even your worst enemy that stole your work and blamed your reputation. A coherent behavior indeed...

It appears that _Pix_ has Farlan/NP3 all wrong...he should be grateful to them for all the free advertising that they've given his terrain tech!

Yes, i hope that Farlan loses. I am saying that from a player's perspective, and from a consumer's perspective.
- In good faith i bought a product from Farlan/NPC, which they never delivered.
- In order to not get billed, i needed to *not* activate my account according to Farlan. However, they contradicted themselves by billing me 6 months later, and telling me that i had to activate the account to *not* get billed.
These are the reasons why people want Farlan to lose. We are consumers, and we got scammed. By proxy, Pix is getting our money back.

On March 13th, 2008 NPCube was dismissed of all its claims in the case it brought against VWORLD before the Commercial Court of Clermont-Ferrand on the grounds of unfair competition and damage to its reputation. NPCube has been convicted and fined 50, 000 Euros damages to VWORLD.
However on May 2, 2008 NPCube initiates a procedure to appeal against the judgment before the Court of Appeal of Riom.
Pourrieux decided to leave without asking for anything, when release was still uncertain due to technical issues, and now that we have worked on his "mock-up" to turn it into an actual game, he's tried to squeeze money out of us
This site is slander, pure and simple. Farlan has already taken all necessary steps to make sure the law will be enforced and the third party sites which relay these slanderous allegations erase the messages in question. By the way, why choose the Web rather than Court to assert one's rights? Farlan will take the initiative to seize the Court for that subject matter.
No such Court action has been brought agaisnt Mr Pourieux to date, that is, two years and a half after it was publicly announced, and this news was relayed and translated in various languages on many Internet websites.

Or, maybe not. Since it's no secret that China is the world capital for pirated wares (and knockoff Gucci bags), _Pix's_ attorney may have an even-bigger war to fight. VWORLD tech could very well end up "in the wild" over there. THAT fight could take years. Mr. Jacquet may just as well stay in China now, since they don't extradite (well, not to the U.S., at least).

Ah, but thanks to the EU government public funds and the Reunion Island University funding NPcube/Farlan puts them in the crossfire. _Pix_ attorneys can go after them to some extent ( as they should have had more than enough manpower/resources to check all of this out in the beginning instead of trying to blindly back Farlan because they didn't want to admit they may have made a boo-boo ), and let the government/university deal with getting the money they lose to _Pix_ back from Farlan in China.
Well, the surprising and rather contradictory news to me is that they've just fired the rest of their personnel on the grounds of economic reasons but they do appeal agaisnt the 13th of March judgment condemning them. BTW they' ve already obtained a delay in this appeal when VWORLD asked the Appeal Court to pronounce the enforcement of the judgement regarding the amount they were convicted to pay.
So what is the next step? I guess we'll see a number of posters putting forward "it's all Pix's fault " if they fired every single soul at NPCube.

I doubt very seriously that much of the blame for the firing is going to be honestly felt against _Pix_. By all that has come out and will continue to come out, the hurt employees will figure out that Farlan is the dastardly villian in all of this.
Then again, there is the chance that the "firing" was on paper only. Farlan could have very well "fired" them from Farlan but employed them in another unnamed company. They are so fond of smoke and mirrors, its hard to take even this news without looking at all the cracks too concerning anything with Farlan.

I dunno know about that either. WIth the posts that come out from Farlan such as "we must not let them break us", and "we must attack our attackers" (attackers being disappointed players, ripped off customers, etc) and the like, the most laughable being "the truth will come out and we will be avenged" (BWHAHAAHHAAA) Farlan may have just told them the "potential" of their layoff as saving the company somehow and welp, if they have stayed with him this long, they surely took the bait.

Unfortunately I think the DNL "franchise" is less than worthless. Most players who were even remotely interested in it wouldn't touch it with a 10 foot pole.
Not to mention it would be quite an expensive feat to fix all the crap in DnL, not to mention code in all the missing features.
I saw a few people say these guys might take flight. Can you not get the legal system to bar these guys from leaving the country until this is solved?

Lol. I think VWORLD would rather prefer to simply and quite logically get the money NPCube was fined . A DnL "franchise" would not be indeed a good deal, since this "franchise" would come along a certain number of "promised features" DnL customers already paid for, but didn't get effectively:
- VWORLD would have to design, print and send thousands of maps
- VWORLD would have to design, run and promote a server technology suite capable of handling hundreds of thousands millions of players on the same server
- VWORLD would have to design, write, and translate a game design
- VWORLD would have to re-gain the confidence of the customers that were repeatledly charged on their Visa
- etc, etc, etc
The only feature that VWORLD would be confident to provide without going the long lie rope would be the seamless big terrain which seems in the end to be the One remaining asset of Dark and Light.
and for the record...I believe they already fled the country, as, you know, all innocent people commonly do. I personally always liquidate what assets I have and flee to china every time I'm winning a court case because I am honest and in the right...

BTW I've been informed that NPCube has been convicted in yet another case and that the Clerk's Office has just informed the winning party that their Office was not in a position to notify NPCube since its manager Cesar Jacquet was nowhere to be found on Reunion Island/France.

As a reminder, four years ago, on July 6th, 2004, Mr Laurent Paret was informing M. Vincent Pourieux of certain "remarks" that some of Farlan's and NPCube's associates had voiced towards VWORLD, indicating their intention not to let VWORLD flourish in peace :
- that we were going to be haunted for the rest of our lives with this failure
- that Frederic and Dominique will get down to piss everybody off and above all not to get off VWorld's back if we stop
As a reminder also, Farlan had been publicly announcing as early as November 2005 that it was sueing Mr Vincent Pourieux , and NPCube claimed that Mr Vincent Pourieux had attempted to get money out of them :

Pourrieux decided to leave without asking for anything, when release was still uncertain due to technical issues, and now that we have worked on his "mock-up" to turn it into an actual game, he's tried to squeeze money out of us
This site is slander, pure and simple. Farlan has already taken all necessary steps to make sure the law will be enforced and the third party sites which relay these slanderous allegations erase the messages in question. By the way, why choose the Web rather than Court to assert one's rights? Farlan will take the initiative to seize the Court for that subject matter.
No such Court action has been brought agaisnt Mr Pourieux to date, that is, two years and a half after it was publicly announced, and this news was relayed and translated in various languages on many Internet websites.

Mr Vincent Pourieux writes an open letter to the President of the University of Reunion Island, Mr Serge Svizzero, demanding an explanation on the E-Campus project and the European public funds (ERDF) granted to its development. The E-Campus project is based on a partnership between the University of Reunion Island and the Reunionese company NPCube : this project takes advantage of the technical features of VWorldTerrain technology, without giving credit to its inventor and without being governed by licencing agreements with VWORLD.
Mr Serge Svizzero, President of the University of Reunion Island, has not given any reply to this open letter yet.

Or, maybe not. Since it's no secret that China is the world capital for pirated wares (and knockoff Gucci bags), _Pix's_ attorney may have an even-bigger war to fight. VWORLD tech could very well end up "in the wild" over there. THAT fight could take years. Mr. Jacquet may just as well stay in China now, since they don't extradite (well, not to the U.S., at least).

Ah, but thanks to the EU government public funds and the Reunion Island University funding NPcube/Farlan puts them in the crossfire. _Pix_ attorneys can go after them to some extent ( as they should have had more than enough manpower/resources to check all of this out in the beginning instead of trying to blindly back Farlan because they didn't want to admit they may have made a boo-boo ), and let the government/university deal with getting the money they lose to _Pix_ back from Farlan in China.

Well, the surprising and rather contradictory news to me is that they've just fired the rest of their personnel on the grounds of economic reasons but they do appeal agaisnt the 13th of March judgment condemning them. BTW they' ve already obtained a delay in this appeal when VWORLD asked the Appeal Court to pronounce the enforcement of the judgement regarding the amount they were convicted to pay.
So what is the next step? I guess we'll see a number of posters putting forward "it's all Pix's fault " if they fired every single soul at NPCube.
Future will tell. History continues to be written. Time, you know, is rarely your enemy when you're armed with patience.

I doubt very seriously that much of the blame for the firing is going to be honestly felt against _Pix_. By all that has come out and will continue to come out, the hurt employees will figure out that Farlan is the dastardly villian in all of this.
Then again, there is the chance that the "firing" was on paper only. Farlan could have very well "fired" them from Farlan but employed them in another unnamed company. They are so fond of smoke and mirrors, its hard to take even this news without looking at all the cracks too concerning anything with Farlan.
Odd too the whole lot was fired but the game continues to run. Was there any "real" devs employed in the first place?
Well, if Mr. Jacquet is indeed laying off all of NP3, then perhaps you might could find a disgruntled employee or two that could lend strength to your cause, _Pix_. It happens all the time over on our side of the pond...employee gets laid off/fired by big unscrupulous employer...employee later blows the whistle on/testifies against said unscrupulous employer. (Enron comes to mind.)

WIth the posts that come out from Farlan such as "we must not let them break us", and "we must attack our attackers" (attackers being disappointed players, ripped off customers, etc) and the like, the most laughable being "the truth will come out and we will be avenged" (BWHAHAAHHAAA) Farlan may have just told them the "potential" of their layoff as saving the company somehow and welp, if they have stayed with him this long, they surely took the bait.

Edit: regarding collection. Once all the court proceedings are over, depending on the number of creditors and local laws, if the company does not have enough money to pay debt, usually it means you can force them to sell their assets (including hardware and/or any IPs they hold). who knows, maybe Pix will end up owning D&L franchise!

Lol. I think VWORLD would rather prefer to simply and quite logically get the money NPCube was fined . A DnL "franchise" would not be indeed a good deal, since this "franchise" would come along a certain number of "promised features" DnL customers already paid for, but didn't get effectively:
- VWORLD would have to design, print and send thousands of maps
- VWORLD would have to design, run and promote a server technology suite capable of handling hundreds of thousands millions of players on the same server
- VWORLD would have to design, write, and translate a game design
- VWORLD would have to re-gain the confidence of the customers that were repeatledly charged on their Visa
- etc, etc, etc
The only feature that VWORLD would be confident to provide without going the long lie rope would be the seamless big terrain which seems in the end to be the One remaining asset of Dark and Light.
