AoC and the Gamer's Bill of Rights

Lets see how AoC does on the Gamers Bill of Rights (see: http://www.edge-online.com/blogs/the-gamers-bill-rights )

1. Gamers shall have the right to return games that don't work with their computers for a full refund.

AoC is check I guess.



2. Gamers shall have the right to demand that games be released in a finished state.

Oops.



3. Gamers shall have the right to expect meaningful updates after a game's release.

Oops.



4. Gamers shall have the right to demand that download managers and updaters not force themselves to run or be forced to load in order to play a game.

ok



5. Gamers shall have the right to expect that the minimum requirements for a game will mean that the game will adequately play on that computer.

Oops.



6. Gamers shall have the right to expect that games won't install hidden drivers or other potentially harmful software without their express consent.

ok as far as I know.



7. Gamers shall have the right to re-download the latest versions of the games they own at any time.

ok



8. Gamers shall have the right to not be treated as potential criminals by developers or publishers.

9. Gamers shall have the right to demand that a single-player game not force them to be connected to the Internet every time they wish to play.

Overall Funcom is in violation of the Gamer's Bill of Rights.

    Every MMO game I am aware of bans players for exploiting and gold selling, and they're all missing content at release. As a matter of fact, #2 and #3 are almost contradictory.

    Memory errors ?   I highly doubt ppl will be able to get refunded for it.  My m8 was UNABLE to get his game refunded even tho he was unable to play cause of the memory problem - I will personally ask him to contact Funcom to get refunded.

    Sorry but when you click "I agree" on their EULA,  you are playing by their rules.  It does not matter if someone else made up their own bill of gamer rights because it does not apply to you. The EULA is the only thing that applies to you. 

    I agree that some companies should do things differently but threads like this are pointless.  If you do not agree with their policies, walk away.  Thats all you can do.  The EULA has you by the balls and all companies have one that you must agree to.

    Its kind of like visiting another country.  When you enter, you agree to abide by their laws.  They do not give a crap about what your rights as an american, british, french, etc. citizen is.  They determine what your rights are.  Thats just the way it is.

    The EULA has already proven to not hold up in court. So.. yea... it's just something useless that you have to "agree" on.

    I think you copu;d very easily return conan to the retailer you bought it from in your subscription period at least - and say the game isnt as described.

    Purely on the DX10 issue alone but certainly on other aspects too.

     

    And for any misguided yanks out there youll find that most EU countries have better/equal consumer protection laws than the USA, and we do customer service better than you too !

    ^^ He speaks the truth. If you have to sign a contract in order to even see the product for the first time it is in violation of the law. Now if you were allowed to play for a week before signing the EULA then your screwed.

    Why don't you just get yourselves better consumer laws?  As an Australian we have consumer laws that allow us to return any product that does not match the description on the box - including computer games.

    That is how it should be. 

    Honestly, visit your Congressmen/women and local reps please.  Tougher consumer laws regarding computer software in the USA would help us all.

    Also, as for signing the 'contract' (EULA) before you see the product...

    What the law 'sees' is the point where the money changes hands.

    So, in the case of the EULA:

    The 'contract' is not sighted until after the money has changed hands.

    Under Common Law in most Commonwealth countries this is considered a "Ticket case" which is a very curly area of law.

    It doesn't make the EULA 'illegal' but it also does not make it binding either...

    It would be decided on a case by case basis in court.

    You as a consumer have a means to put them out of business, given enough people agree with what you deem a worthy videogame. If there isn't enough people who do agree, Funcom carries on business as usual. That's what makes a free market great, everyone gets what they want.

    They put a carrot on stick every time resub times comes and say we have  xxxx almost finished and ready to implement every month. And every month we see nothing until but bad patches if we get patches till its time tor resub again and they put out more we have xxxx almost ready.

    Good post OP my gamer bill of rights will be to convince as many folks from this day forward not to buy or play anything the Funcom sells or makes. They will grow not to like me much.

    That bill of rights is the most worthless POS I have ever read in the gaming community. It's from a troll that apparently got mutated with a dictionary.

    Not many places on earth endorse slavery. Demanding and forcing someone, or even a company is slavery. You do not own them. They do not owe you anything.

    It is fully your choice to buy and pay for video games. It is your choice how you live to an extent, where it does not accept chaos and force others into a place where they have no choice in how to live.

    You bought the hype. You bought into the hype that 30% Funcom, 70% gamer brought you. I can not force you to believe me, as well as nobody could have forced you to buy that game.

    You have no right to demand anything from anyone.

    I think the best way we can force game companies to make worthwhile games is not paying to play a piece of poo. 

    I still have my Vanguard and Tabula Rasa boxes sitting on the shelf.  If the games ever become better I may go back and play them, but not until then.  SWG is still there too, along with the JTL expansion.  I really dont want my $30 to $50 bucks back at all, and if I had bought AOC I still probably would keep my hard copy of the game in case it ever became fun.  If these games want my sub back, they should make their games better.

    I am not going to sue anyone for my game that cost under $60.  The lawyer will cost more than that.

    QFT.  It is hard to find any retailer that will take a game or any other software back that comes with a CD KEY once the package has been opened.  Gamestop doesn't owe me $50, Funcom does.

    In that case, you are wrong about #3.

    For example, Black Temple was missing from the expansion, but it was added in an update.

    So that would qualify as meaningfull update.

    You are also wrong about #6, since it actually is with the users express consent.

    So yes, it still fails at #2 and #8. Quite a difference from AoC.

     

    That said, I dont find this Gamer's Bill of Rights really usefull for any MMORPG. If AoC was actually fun to play, I would not mind at all that they failed this Bill of Rights.

    after what happend to aoc . dont think any other game will make that mistake again . seen  how much a game can be riped apart buy  players and forums 

    . in uk you do have the right to return the game  up to 14 days you have  to send it back . as i bought mine from play.com  i never botherd
