Who was the first black president again?

Ever wondered who is at the helm while one president is relieved of duty and before the next is sworn in?? Here are some interesting facts for you to chew on.

I should add that the language of the Presidential Succession Act actually puts the Speaker of the House of Representatives (Nancy Pelosi) ahead of the Secretary of State in the line of Presidential succession. But most Constitutional scholars believe that an “interbranch appointment” of this nature would unconstitutionally violate the doctrine of Separation of Powers. Which is why I said that the Secretary of State would be next in line, rather than the Speaker of the House.Also, you should know that in order for Presidential succession to be passed to the Secretary of State, or Speaker of the House, those positions must be vacated by the new appointee. Neither Pelosi nor Byrd resigned their current positions, therefore were disqualified.



(1) The 20th Amendment provides that “[t]he terms of the President and Vice President shall end at noon on the 20th day of January. . . . ”

(2) Art II., Sec. 1 Cl. 8 provides that “[b]efore he enter on the Execution of his Office, [The President] shall take the following oath. . . ”

(3) President Obama did not take the Oath of Office until about 12:03 pm today, after Vice President Biden took it at about 12:01 p.m.

(4) Therefore, there was a brief window (just after noon) when George Bush and %!*% Cheney were no longer President and Vice President, but Barack Obama and Joe Biden also were not yet qualified to enter on the Execution of their offices.

(5) The Presidential Succession Act, 3 U.S.C. sec. 19(a)(1), provides: “If, by reason of . . . failure to qualify, there is neither a President nor Vice President to discharge the powers and duties of the office of President, then the Speaker of the House of Representatives shall, upon his resignation as Speaker and as Representative in Congress, act as President.” Section 19(b) states that the President Pro Tempore of the Senate shall act as President {under the same terms and conditions} if the Speaker of the House fails to qualify.

(6) Neither Nancy Pelosi nor Robert Byrd actually resigned their seats in the Congress.{They would have to resign their current position in order to take the presidential seat} Thus, neither of them qualified to become Acting President under the Presidential Succession Act. Plus, interbranch appointments might be unconstitutional anyhow. See Akhil Reed Amar and Vikram David Amar, Is the Presidential Succession Law Constitutional?, 48 Stan. L. Rev. 113 (1995); but see Howard Wasserman, Structural Principles and Presidential Succession, 90 Ky. L.J. 345 (2002).

(7) Section 19(d)(1) of the Presidential Succession Act provides: “If, by reason of . . . failure to qualify, there is no President pro tempore to act as President under subsection (b) of this section, then the officer of the United States who is highest on the following list, and who is not under disability to discharge the powers and duties of the office of President shall act as President: Secretary of State . . . ”

(Cool Notably, Section 19(d)(1) does not condition the Secretary of State’s assumption of the powers and duties of the office of President on resignation of her current office, nor does elevation of the Secretary of State raise any constitutional issue of interbranch appointment.

(9) The term of office of the Secretary of State does not automatically terminate at noon on the 20th day of January.

(10) On January 20, 2009, Condoleeza Rice was (and is) still the Secretary of State.

(11) Accordingly, from 12:00 noon until 12:01 p.m. {when Vice President Biden took the oath of office and became Vice President}, Condoleeza Rice was momentarily the Acting President of the United States, our first African-American and first female President.

    Well if you wanna get into technical terms, " He's Mocha,Just a few pigments Darker." And i agree, he's 50/50.

    To me Obama is white, I mean didn't his caucasion side of the family raise him. So his cultural stance would be white.

    Me im mixed im, black,white,latin american and sioux indian and when some one ask's me what i am, i always say, " Mix/Heinz 47."

    So really we dont have a black president, we have a mixed president. Damn the media : ( They always screw up...

    As much as I distrust the man, fully black or not, his appointment is a huge step forward from the bleached white we normally get in our commanders in chief.

    It just goes to show you how progressive the Republicans are.  Not only did they end slavery, they also put the first woman, and first black citizen as president of the United States.

    I do not think that he was trying to be rascist I think that he was just stating a fact. Everything can be twisted to be a racial comment, but its all about how the people see it.

    lol,  yea,  all these slave owning republicians running around lynching folks,  they are the party of keeping the poor poorer.   Which reminds me,  need to go and pick up my welfare check this month.

    Technically, the party that kept the poor poorer was the Democrats until Reagan took office.  The instituted a 90% income tax on upper income preventing many Americans from becoming rich, while the rich then would put the money into offshore accounts and slowly take funds out so they were under the upper income bracket.

    Under both Bush and Reagan, there has been a growing amount of the wealthy in the US.  There are several times more in the upper income bracket then in the past.

    I say it is a step forward because it shows that the people are willing to elect someone from a minority race, nothing more, nothing less. My statement did not say or suggest that I believe that someone of purely caucasian descent is unfit or somehow less fit for the office, and I would not spend a moment being concerned over the race of Obama's successor.

    Actually it kind of did. The "bleached white" remark is what made it. Now, imagine if someone said "This is a great step forward for chocolate browns."

    Apparently it is now racist to comment on the fact that untill quite recently every single president in America's history was white. A simple observation of a trend should not have been taken so seriously.

    By the way, this is not a step forward for any particular race, but rather for our people as a whole.

    I was being sarcastic with the earlier post,  Republicians do support the rich.  They try and make as many rich individuals as they can,  it's where the parties strongest ties are,  making money. 

    Democrates have always catered to the poor,  and they try to make as many poor as they can. 

    Just depends on what an individual believes their goverment should do.   Should the people be in charge and take care of the government or should the government be in charge and take care of the people.

    I really wish they would give credit and praise to the Biracial population

    The president-elect becomes president at noon, whether he/she takes the oath or not.  "Before he enter on the Execution of his Office"  Recognizes that the presidency is his when it calls the office of the presidency "his".

    Condoleeza Rice was Secretary of State and remained Secretary of State and at no point was ever president.

    OK if obama is mixed and does not take credit for it.

    I don't think he should be in office. Becuase if he is  too weak to claim that he is mixed that ounce again shows a weakness.

    They all seem to be weak in some way or another and what makes me angry is that false promises seem to capture the mass population.

    Obama said i want the military out of iraq, then why are we staying till' 2011. Then the United nations declared a cease fire on iraq and afghan i believe. And they did not cease, so now we are fighting this war tll god know's when.

    The bonus a military recruit gets " 20K" is being taken away next month.

    To supposedly save money, BULL**** IF THE GOV. WANTS TO SAVE MONEY THEN PULL THE TROOPS OUT.

    So already these...webs of lies are starting to spin.

    Black/White/Brown I hate the fact of having a president. I Believe america should be united under a council. With representives from all wealth classes. And they should have the same pay as the AVG. Worker. MONEY CHANGES PEOPLE
