At least in the country where I live, which belongs to the EU, what a company announces in their publicity is legally binding, so yes they can be sued if they don't deliver what they promise in the ads.

Consumer protection laws don't apply to companies overseas and you still have to pay a lawyer to file. It's not something you can do in small claims court.

If the law in your country does not I suggest you contact you local government representative.
*I should be more specific: Australian Law specifically allows you to use the consumer law in other countries. This closes a loophole allowing businesses to redirect you to your own countries law ending up in an endless circle.
So, in the case of AV an Australian could use Greek consumer protection laws - which in this case are also mostly EU laws.
I know some EU countries have Government Departments that handle these matters. You can do it via e-mail in some cases.

If a company doesnt supply what they promised as outlined in whatever section of the T&C then you have the right to cancel.

The only real problem with this game that I see, is the devs inability to deal with customers in a professional manner.
Had they communicated properly, not shut dowwn their own forums, dealt with billing issues in a timely manner, there wouldnt be this outcry.
Game and servers work like a charm at the moment. They still have problems with some accounts, and they're working on them as much as they can.
Some people ingame are experiencing problems, but that's "normal", every game has problems with some people, question is, will or can they be fixed.
Biggest issue right now I guess are some mobs, that still are exploitable.
