LOL they should sue the player? Or the STAFF member that modelled the characters?
Either way, the company is the one which should be punished. Down with CoH I say.

Yeah but NCSoft said they own all the charaters that anyone makes so that they can stop people selling accounts
I can't really see this lawsuit going anywhere. There have been games in the past with create a player that you could model your player after tons of different copywrited characters and nothing ever developed with those.
CoH has a good fan base and is a really fun game. With City of Villians expected to be out in the next few months i am sure they will reach some kind of agreement outside of the courtroom.

Good question. Perhaps I'm used to thinking of that genre as a niche market. But there are many similar (and successful) fantasy games. Perhaps there could be a couple superhero games. But it would certainly benefit Marvel's game to have COH off the market. It would help Marvel even if COH is just ordered to revise the character generator to limit what players avatars could look like. I always thought the character generator was the best part of COH.
I don't think genre plays as much a role as gameplay. if the gameplay is good it will be successful. If the gameplay sucks.. well need I say it?

Fantasy titles tend to get my immediate interest, but I agree with you there. I'd rather play a game with good content than the norm... anything but the norm...
