With the news of the coming expansion a lot of new people are taking a look at Darkfall. Its Vital you know one thing if your not from inside the EU and would prefer to play on the US server.
DO NOT BUY THE GAME NOW
The current client is for the EU server. If you buy the current version of the game you will NOT be able to play on the US server at launch. Just like you can't play WoW in the US with an EU account or WAR or AION.
You will be able to transfer your character over in 3 months from the EU server to US server BUT it will cost and there will be a bunch of restrictions.
If you want to play on the EU server then now is a fantastic time to jump into Darkfall, but if you want to play on the US server at launch you MUST wait unless you want to end up buying 2 clients.

Really????? I nor anyone else ever bought a EU client, I bought an EU account. The game has NEVER been for sale anywhere in any form.
What I downloaded was a free client off a torrent and I am sure that the US version is the same.

JTBanker, you didn't buy a client, nor did you buy an account. What you bought was a license to play the game using your account (which could be created for free, like mine was months before I subscribed) and the client (which I downloaded for free via torrents prior to the launch). That license (at least the copy I have after I first patched up the game on April 30th, when I subscribed) states:

1. Limited License to the World. Your participation in the Game and the World are subject to your ongoing agreement to and compliance with these TOS. Aventurine grants you a non exclusive, non transferable, revocable license to the Game and the World, subject to these TOS and the EULA. You may only use the Game and the World for your entertainment. Any commercial uses of the Game or the World by you is strictly prohibited.
"
This is common verbiage. Gamers don't buy "software" or "games", they buy the license to use or play them. Frankly, I think the wording used by Tasos regarding the "American Darkfall client" is just poorly phrased. Additionally, the EULA states:

5. Darkfall Account. In order to play the Game in the World each player must establish an Account with the Darkfall online system. When creating an account you will provide Aventurine with personal and financial information as well as the Authentication Key provided to you when you purchased the Game. You must provide accurate information to Aventurine and update that information promptly after it changes. Once you establish your account you will select a player name and set up a password for your account. Do not share your player name or password with anyone else. You are responsible for maintaining the confidentiality of your account player name or password, and you will be responsible for all uses of your account player name or password, whether you authorize its use or not. In the event that you become aware of or reasonably suspect any breach of security, including without limitation any loss, theft, or unauthorized disclosure of your account player name or password, you must immediately notify Aventurine at the contact email address on the official Darkfall website.

Notice, nowhere in the EULA does it state you own the client, your character or even your account. You simply paid for the license to play the game in Aventurine's virtual world.
All that being said, it is interesting that the EULA doesn't contain any references to AudioVisual or their right to distribute the game and/or manage player accounts/billing. Additionally, the EULA doesn't reference the game client or world only being licensed for The only company references are to Aventurine, themsselves. Why is this interesting? Because the publisher should be included in the EULA. Case in point, there are separate regional EULAs for each publisher of LotRO:
If the Aventurine is self-publishing in North America and they don't have a separate EULA for the game, then signs point to them being greedy and underhanded, in which case they'll alienate even more customers.

Rhinok, you are better then this. You really don't want to get into symantics games do you? You know damn good and well that you couldn't buy a license to play without an account so you effectively bought the account.
Let's not start getting into all the BS that is in a EULA which has NEVER been enforced in any court anywhere that anyone can provide a citation for. There have been copyright violations which people think are EULA or TOS violations but they are a totally different animal.
Suffice to say, this whole NA server thing sounds fishy and stinks to high heaven being only 6 days away with no known NA publisher.
I really don't care about how you want to define it.
All I want is to make sure no one buys the EU client thinking they will be able to play on the US server.
Only stupid people will do that.... oh wait!

Yeah, that is a good thing to try and make clear.
Unfortunately, Aventurine chose NOT to make the same disclaimer when their customers plunked down their $50+ for DarkFall.
