"You cannot use virtual world elements that are found in pieces of online software such as SecondLife and use them in a video game for a 50.00 retail price."
That made me laugh. They can do whatever they want to do. It is your fault for buying it.
If you are that unhappy with your purchase and you absolutely cannot get your money back then I'd be happy to take it off your hands for $5 (assuming the key is unused) :P Personally I love the game and have nothing but good things to say about it. Yes, the beta was a bit rough. Yes, the launch will likely be pretty rough. But you know, name me ONE MMO that did not have a rough beta or launch?
I'll save you the time thinking: there are none. Champions Online ALMOST had a smooth launch till they stupidly made massive changes between the end of beta and launch. So much so that people revolted when they found out.
Fallen Earth just needs a little time to smooth out the glitches and balance a few of the issues. Sorry if you didn't care for it, but as everyone else said, chalk it up to experience.
Earlier today I purchased your game Fallen Earth from Direct2Drive.com for
49.99. I enjoy the genre and the setting, and the story line sounds
intriguing. Screenshots look nice, promotional videos show some cool scenes
... sure, I'll buy it. Looks compelling. I'm now curious who I need to talk to in order to get a refund. When a
company charges 50 dollars for a new release game, especially an mmo, you
assume
I am condensing your post and highlighting a keyword.
Don't assume anything, you make bad choices when you do. If you feel the game isn't worth the 50.00 you plopped down, then you shouldn't have assumed greatness and jumped the gun in purchasing. Now you cry foul and say shame on them.. I say shame on you!
I tried it in beta, thought it was fun, but I didn't buy it, and I don't plan to buy it but that's neither here nor there... With that said I don't think they owe you a damn thing.
And then you make a public declaration that you are going to pass this information along in an attempt to try to piss other consumers off and to pursuade them from buying their product, hoping to hurt them because you weren't smart enough to research a product before paying for it.... Okay.
Well, you had plenty of opportunity to try it out without buying a preorder. Fileplanet after...what...4 days opened it up to non-fileplanet registered users to download the open beta. You also had plenty of notice on the D2D site that this product is not eligible for refunds. So, if anyone is going to take your post as a "buyer beware" then they also need to factor in the actions of the "source".
As for your "conversation" with D2D customer service, well, anybody can post anything on the internet they want. That doesn't mean it's credible or true. *shrug*
"Many nights, my friend... Many nights I've put a blade to your throat while you were sleeping. Glad I never killed you, Steve. You're alright..."
Welcome to capitalism... the only influence you can ever have on the price that a 3rd party sets is by a) buying the product, b) not buying the product or c) getting a job with the company setting prices. I for one can't wait until this game launches. I pre-ordered several days ago.
The setting is fantastic. The crafting system is the best in the mmo industry. The world is large and populated with many hard to find bunkers, landmarks and MOBS (yeah Darkfall, not all companies wait a few months to actually add mobs).. The skill system and min/max ability is superb. There are hundreds of unique items instead of level specific level sets like shitty WAR and AoC. Every character is 100% different. You will never find two of the same level characters with even 50% of the same gear on. There are axes and machine guns. There are Mad Max cars and ATVs with terrible animations.
Sure the game has an amaturish engine and is full of bugs but it is a wonderful gaming experience none-the-less.
I am picky and hated every game I have played since EQ1 and then WoW and this game has come closest to actually enchanting me.
If Second Life is this much fun and is as similar as you say, sign me up for that too.
And another thing, you entered into a legally binding agreement with another party to exchange your money for their product. They never hid the fact that they used some 3rd rate engine to design it or that their primary intent is to market the engine which I can't imagine anyone actually buying.
not to split hairs, beat dead horses, or start a flaming parade for myself...but...
that's the loosest usage of the term 'open pvp' ive ever seen.
i think the game is fun, playable, and is what it is...im buying it...but it doesnt have at all what i consider to be open pvp, yet.
Actually you aren't splitting hairs, beating a dead horse or anything. You're cherry picking words from a complete sentence.
•Tactical Player vs. Player: Battle in one of the open PvP zones or wage war with the factions to claim control of towns.
Is the complete statement. Battle in one of the open pvp zones is EXACTLY what the entire sentence states. A ZONE where there is OPEN PVP. They never claim to be an open pvp game, probably because they want to be niche but not that niche.
OP is clearly, unquivocally, a troll of the first order.
The game is in excellent shape and if the end of beta was any indication is set to have a truly stellar launch compared to many I have participated in previously.
It is innovative, engaging, fun and refreshing.
If any of these things don't appeal to you, by all means, avoid the game like the plague. I and many others are eager to play in the pre-release period and are anticipating great times ahead.
OP, you paid for something that was ultimately not for you. That doesn't make it inherently flawed, terrible or the anti-christ you paint Icarus studios to be.
I think that this game is pretty darn awesome. Been waiting for someone to make a post-apocalyptic game for a while. These guys might not have the most user-friendly product out there right now, but their concepts, systems, and customer service are all very much on the right track.
I've been involved in testing a lot of MMO's over the past several years, and this is the first time I've seen GM's active in the game at almost any hour during beta testing. And by active, I don't mean that they respond to your questions 30 minutes later. The GM's were available in the new player chat channel almost constantly. If you had problems, you could tell them, and they could work to assist you. When I submitted bugs, I got responses within 24 hours. In many of those cases, fixes were available within a few days.
That said, there are some bugs out there still. But the way that this team handled their potential customers during the beta convinced me that if I was going to give someone $50, it was going to be them.
This game is not for everyone. It's not a WoW killer by any stretch of the imagination. However, it is a very good game, and in time, I think that it will carve out a niche with success similar to Eve.

I'm actually wasting my money and preordering/beta-ing Aion and Fallen Earth. I intend to stick with the one I like better after three months or so. I don't expect either to be a "WoW-Killer". However, I'm sick to death of WoW, and I never really liked it that much to begin with.
I really like MMOs that aren't in the fantasy genre, so Fallen Earth really intrigues me. I don't see any valid points in OP's post. If he had logically lined up the things he did not like in terms of controls and graphics it would have meant more. There's a lot of filler there. For example, "I think that the player combat animations are too jerky" or "the mouse controls are inverted".
OP claims to have never gotten into Beta, yet screams and rants about gameplay before the game is even available for play through pre-order (which is 9/9).
Moderator- please kill this thread and bury it six feet under.
First, I pre-ordered the game today via D2D in order to gain access to head start. I'm happy with my choice, I'm looking forward to rolling my toon in about 6 minutes.
I wanted to comment in regards to the controversy about "refunds through your credit card company". I do agree with the view point that it is unethical to claim a falsity in order to get a refund.
BUT..
The OP could, without violating ethics get a refund through his CC with the following argument:
1) The release date for the game was changed significantly (anything over 3 days I believe) which it was changed by 2 weeks or so
IMO, this is an honest way to pursue a refund if one so desires. I won't be... head start begins in 3 mins!
Apparently you have no idea how much money it costs to make an mmo, especially when it is coming from an independant company that does not have a budget like WOW to implement the money and manpower to iron out the bugs. These funds will pay for them to turn this into a smooth bug-free game, which if they don't have the funds at release, means we have to wait longer, which means they lose customers, and they go bankrupt....do the math.

ITT: 10 year old buys Fallen Earth because he thinks it'll be his twitch, ADHD enhanced Halo-esque pwn BOOM HEADSHOT game, only to find out it's an MMO, and then comes on forums to troll and inflate his e-peen by acting like he's the logical one, and we should all bow under his intellectual prowess.
No different than the people who post videos of themselves harassing police officers to convey the message "lol [bleep] da poh-lease" while hiding behind "I'm sticking up for my rights."
I see people like the OP where I work all the time (Stadium, serving food). The kind of people who think they can eat three quarters of something, and then return it for a full refund because they "don't like it," and then act like they're the victim of fraud when they are told "no."
OP's mommy needs to change her credit card number, or child-lock the PC.
I think what this should point out to all MMO consumers is to buy games that have free trial period. I learned from WAR when it came out to not buy any game that I wasn't give the chance to try first. Most have a 14- day perid, WoW has a 10-day, but honestly- I know in a week or less (sometimes in 5 minutes) whether or not a game is for me. I was on the open Beta for Fallen Earth and I think its a pretty decent game and I might buy it in 6 months after they've hammered out some of the kinks (again, thank you EA/Mythic for teaching me to not buy new releases).

On the other hand, while there are some problems in the game, as of yet people are not as disapointed and regrettin (seemingly) that they bougth the game as the OP is. There have to be reason for that.
The point is, this game is not worth anywhere near 50.00 + the monthly,
This does seem to be your main point, and unfortuantely, that's the case with lots of games, and especially MMOs. The $50 price is standardized, it's what all new games cost, with no sort of sliding scale based on quality or quantity of content. It will be in the budget bin soon, but not right away. As frustrating as it may be, it's just the way it is.
When I want a single-player story, I'll play a single-player game. When I play an MMO, I want a massively multiplayer world.
Maybe you were too much of a prick in your letter to them? I sent this email to support and requested a refund of my pre-order.
Dear Support,
I'd like to cancel this pre-order please. I've not used the key or the codes, nor have I downloaded the product. Please inform me when the transaction is completed. Thank you.
v/r...
That was 8 days after I had ordered. I got a personal response saying they were working on the refund. Still no refund after a few days, but I don't doubt it will be any day now.

I agree the game is total crap that should never been created, but expecting a refund is just dumb.

Sorry people saying this game is a pile of poo are stupid.
1) the game says what it is and lives up to it.
2) Its a new starter game, it will have bugs
3) The game is not your standard setting so the 12 year olds won't like it.
4) The controls are very similar to a good few games out there - niche games maybe - but used, Neocron for example
5) IT IS NOT AN FPS GAME GET OVER IT. :-)
Oh and the OP is a just a tard with no idea on researching a game before buying it.
