Am I correct that this game is actually 3rd person? If so how can it be refered to as an fps?

That’s a rather subjective (and combative) way of looking at it. Certainly I know what they are attempting to imply... but the fact is that it is not an FPS. That really sends a mixed message to people.
Even Tabula Rasa could be shifted to a first person view.

The game is third person and zooms into a FPS mode when you use a scope. Any other time you are in a third person view which is still fairly restricted so that you can't see behind you a lot.
