If you are at war then you can anally rape your enemy without reprecussion. But to get in 'at war' status your enemies need to have accepted your war declaration.
This to get rid fo zergs attacking smaller cans and challenging their holdings, basically the clan can decline to enter an official war. So the attackers, if intent on wiping out the smaller clan, will need to be willing to go red to accomplish their goals.
it's not coded where you have to have the killing blow, you have to be on the assault list. murdercounts and flagging has been in beta for a while now, there just was no statloss for reds.
Also you can kill as many reds as you want without reprecussion and anyone who is grey can be killed too. Grey flag is only a short term criminal flag and whenever a blue does soemthign wrong they go grey for a while afterwards. So if a blue attacks me as another blue, then they turn grey for as long as they are being agressive which means that everyone sees their grey flag and can attack them with no reprecussions. Now if a person steals from me then they go grey fro a short period, but only I can attack them, everyone else sees them as blue, either way if i kill them i don;t get a murder count, but if someone else does they will.

My question is... can you take over (or simply destroy) a holding from someone if you are not "At War" with them? If I want to attack XXX clans stronghold and level it, do they have to agree to a WAR? I understand they can still kill the players and go red, but is there some mechanism related to being "At War" and asset destruction?
I guess I see problems either way (and please correct me if I am wrong.. ):
1. You do NOT have to be "At War" to asset destruct. Clan A just walks into Clan B's stronghold and starts to attack buildings. They are not "At War". If Clan B starts to attack Clan A they will get murder points ?
2. You DO have to be "At War" to asset destruct. Clan A has a long running feud with Clan B. But Clan B refuses to accept the War declaration. Clan A can never... ever attack their stronghold?
Again, I am not stating this as fact, but asking if one of these scenarios is how the mechanism works.

You can attack anything, so you don't have to be at war to destroy someones house.
Declaring war in game works like this:
I dont like your clan so my clan declares war on yours.
Your clan can accept the declaration or do nothing about it.
If you accept then when we attack and kill eachother we don't get murdercounts
if you decline then if we attack eachother we do get murdercounts.
They haven't added in seiging yet, but they placed the war dec system in the way they did so that when they do add in territorial seiging, zergs can't just war dec anyone and grab official ownership. it is to prevent everyone from having to participate in a zerg in order to have anything. Even still with enough time and work a zerg can simply destroy everythign you own and setup, but that is more difficult.
So to answer your question, if you are at war then you can take control, if you are not at war you can only destroy. Destroying is alot more work than taking over.
My sig is just as logical as your posts are
I guess my issue with the system as described then.. would be that. Clan A just walks into Clan B's stronghold and starts to attack buildings. They are not "At War". If Clan B starts to attack Clan A they will get murder points.
Looks like a HUGE area for griefing via gameplaying the mechanics.
Hope that's something tested thoroughly before reelase.. by people trying to abuse it before the game goes live.

They have not implemented any of the stuff you people are talking about.
Sieges work like this... SERVER CRASH / CLIENT CRASH..... BOOM!!!!!!!!!!!!!!!
No if youa re a tresspasser then you get flagged grey and the owner can attack you. For instance if you enter my house I can atack you cause you tresspassed in my house.
So defenders have more rights than attackers in this regard, you should look at the flaging pdf file they released like a year ago, it explains it all.
To mr.Skeptical they have inplemented the war declaration system, they did a while ago and houses have always been attackable/destroyable. They even added in a special weapon that does extra damage to houses, the sledgehammer.
However houses have soo much HP that you need a group of people working together to destroy even a poorly made house.
What they haven't added is clan territory and seige mechanics to transfew ownership of said territory, but I think that has been stated already.
My sig is just as logical as your posts are
Guild A declares war on Guild B by paying the war declaration price.
Guild B can either accept the war or decline it by paying the same sum Guild A paid to declare it.
Guild A can attack guild B but the moment they go to Guild Bs land, they turn grey to guild B while Guild B stays blue to guild A. So Guild B can attack guild A without punishment while if Guild A attacks guild B first, they get murder counts and end up in statloss.
houses currently dont just disappear after destroyed, they stay as pile of rubble that can be repaired by the owner for two days.
