After playing the OB part of STO and before applying my game key I made the decision this game wasnt for me. This was purchased as a christmas gift and so I tried to exchange it. D2D wont even discuss it,
I've got over 10 game purchases on D2D, but Ill never purchase another game as a digital download.

It is so stated in the site of product page.
This product is not eligible for refunds and is not eligible to purchase as a gift.
Purchase of this product is subject to routine review for verification purposes. This may delay the approval of your purchase. We apologize for any inconvenience.
This game requires a monthly fee to play. The first 30 days of this fee are included in the purchase price of this package. You must provide a valid credit card to register and play.
Maybe thats why they don't refund you ?
If you paid with a credit card as opposed to a debit, call the credit card company and tell them you received a broken product and would not be refunded. That is if you think the product is broken
Steam gave me no problems canceling when I wanted to switch my DDE preorder from Steam to Gamestop.
You really should check things like this before you order. Fine print is annoying but it's your responsibility to notice things like that.
Also calling your credit card company to do a chargeback and lying to them isn't necessarily a good idea. They will undoubtedly file a report with D2D, and D2D can dispute the chargeback, at which point it might become a legal process. This could also put a black mark on your credit account. I'm not a credit/finance expert, but trying to trick them can get you in hot water.

This is why i never buy a game from D2D, they don't refund online games as far i know.
What would be the "lie" part?
IIRC, the game hasn't "shipped" yet, because it hasn't even been released...
Though I do agree with the general statement that OP should have read the fine print.
Purchase from Steam next time, they will refund you as long as you request it before the release date.
Research the refund policy of the store you wish to purchase before doing it, if you want to be sure of any details.
Because he'd be trying to tell the credit card company that a) he didn't recieve the item, which he did because he indicates he has his key (even if he didn't apply it yet) b) that the product was broken or not as advertised, which it is (whether you like it or not isn't the retailer's fault) or c) that he didn't authorize the charge, which he or whoever bought it did.
When he does do it, D2D will send his card company a note showing them "this digital product is not eligible for refunds or gift purchases" and the credit card company will say "ok" and put a note on his file.

ok how did you get it as a gift when i clearly says not valid as a gift?
and when i bought family guy the episodes were preordered for when they came out after waiting for quite a period of time i wrote an email to d2d to get something for my troubles and ended up getting a sonic game on there dime
Are you really that much of a tool to expect a refund on something that specifically stated NO REFUNDS?
Next time before you or anyone else buys something take the time to actually know about what you are buying. D2D is not responsible for people who dont bother to read the NO REFUNDS policy and then expect one.
I for one am glad they are not giving refunds, hopefully people will learn to pay attention to what they spend money on.
There is a really long thread on the official forums about this:

Go check it out to take a look.
It seems that people that ordered from D2D can't cancel a preorder. It says no refunds, it means no refunds.
Good to know. I'll never order anything from D2D; which I wouldn't have anyway probably.
I order through Amazon. Clickety-click and it cancels nicely.
Even if they did refunds, it seems, from what you said, you already applied the pre-order key. This is not a free trial, this is why they don't accept refunds.
Have they charged you for the full price of the game yet? If they haven't, cancel your card before they charge you. Its a little bit of a hassle to wait a week for a new card but better then losing money on this game.
I would beg to differ also about the game not being broken. Plenty of it is broken.
