After that limit is reached, you have to inquire with Star Vault about getting a refund... good luck on that :

Not quite true.  If it's a billing dispute you are limited to 60-90 days and this is what most banks first default your claim to.  you have to tell them specifically that you are filing a claim under your Claims and Defenses Rights.

If you search these forums or the MO forums you will find step by step directions to take.  Off the top of my head I think you just have to tell them the last date you would have accepted the product and you must have tried to recover your money directly with the company.  You also must be carrying a balance on the card you used (if you paid it all off you can't file a claim).

I received my money back after 5 or 6 months and they even refunded the interest charges.  It was a pretty simple process. I sent them a scan of my receipt and a few emails I sent to SV that were never answered. FYI- Despite any claims... a no refund policy is not valid if the company chooses to accept Visa/MasterCard.  At least as far as I know as I was able to obtain a with no hassle from the card company.

Here is what I found off the net real quick to detail the Claims and Defenses Rights:

Restrictions on "claims and defenses" chargeback rights include:

Under federal and state laws, you have up to one year from the date of the statement (far longer than the 60 day limit for asserting "billing errors") to notify your bank in writing of "claims and defenses." However, unlike billing errors, you must meet four additional conditions:

1.The disputed amount must be over $50.

2.You cannot dispute a charge under "claims and defenses" if you notify your bank after you have already paid your credit card amount down to zero. However, if you have paid off only a portion of your credit card bill, you can still resist payment on the unpaid balance for the charge you are disputing. For example, if the disputed charge was for $300 and your balance on the credit card was for $400 and your payment to your bank was only $150, you can still seek a chargeback for the remaining $250 under the "claims and defenses" category. Unlike "billing errors," whatever you have paid the credit card issuer after the charge appears on your statement which brings the remaining balance below the cost of the charge you are disputing, is not recoverable.

3.The transaction cannot be with a merchant who is located more than 100 miles from your home or outside your state of residence. Exceptions are transactions completed by mail, phone or internet which for these purposes are considered to have been completed in your home.

4.Unlike "billing errors," you must make a good faith effort to obtain a refund or credit from the merchant before contesting the charge with the bank. Sending a letter to the merchant or signing a notice of cancellation which is sent to the merchant would suffice as a good faith attempt to resolve the matter with the merchant. Be sure retain a copy of your correspondence.

Be aware that many customer service representatives are not familiar with claims and defenses. Some representatives have denied valid claims and defenses which otherwise meet all of the requirements on grounds that the letter was not received within 60 days, or that the merchant has filed for bankruptcy, or that the merchant bank refuses to pay back the card issuing bank because the time limits regulating dealings between the banks under Visa or MasterCard regulations have expired. None of these are proper or legal grounds for denying a valid claim for a chargeback under your "claims and defenses" rights. If you are writing your letter to the bank more than 60 days after the charge you are disputing first showed up on your credit card bill, you may want to clearly explain that you are asserting your "claims and defenses" rights under state and federal law, which, unlike "billing error" rights, are not limited to being asserted within the 60 day time frame.

By law you have a minimum of 60 days to dispute a charge, after that it depends on your CC companies policy.

You make it sound like it would be a bad thing that the game is still in open-beta stage, so at least he should wait till release.

Why should you care if he wants his money back?  He paid... if he wants a refund instead of letting a company charge him and hold his money until they decide to release.. it's his right to get it back.   It's also his right to let them keep it as a loan if that's what he wants to do.  It shouldn't matter to anyone else.

I ordered through Paypal. . decided I might not have time to play. . I would have with an earlier release.  I asked to "cancel" my order. . since it was not out yet.  No response. . emailed through paypal. . no response.  Escalated a claim. . they had 10 days to respond. . no response.  Paypal refunded the entire amount.

There are reasons to cancel a pre-order.  I actually like MO. . I just won't have time to play. . after not getting any response I am sort of glad I did.

Wa min God! Se æx on min heafod is!

i believed they called it a pre-PURCHASE wich means they made him pay up front unlike most games where you pay after the game is released.
