A policy, which is complete garbage. I'm generally not for government intervention, but for cases as ridiculous as these I think old Uncle Sam should step in and take care of business. The issue is really moral, since economically few people use medical marijuana; I don't think allowing legal medical marijuana use will suddenly cause employees to start going on accident rampages and hurting people. If the marginal insurance cost for such an employee is high, then the government needs to take it up with the insurance agencies instead.
Turning a blind eye, however, is unacceptable.

It is impossible to tell with standard tests. They would have to make one specifically for him, but I doubt they would go through the trouble to do that; it's just easier to fire him and state that they were merely enforcing policy. I think testing for anything is dumb. Just because a person tests positive for weed, doesn't mean they're stoned at work. What a person does at home isn't Wal-Mart's business at all. I smoke every day and I never get high at work, at any job. But I do when I come home. It helps me focus on one thing at a time and helps me relax. If I didn't smoke I'd get 2-3 hours of sleep a night. I'm an insomniac.
Now I can see testing for hard drugs like crack or meth. These people are more prone to real crime. They're also more likely to come to work under the influence. They'll steal to feed their habits. problem here is some of the harder drugs only stay in your system for a few days. Where weed will stay in your system for up to 90 days depending on how much body fat you have. So really the drug testing only discriminates against the people using the lesser evil. if I ran a business, I'd be more worried about alcoholics and meth addicts. Marijuana doesn't make you dysfunctional. Despite what Reefer Madness will have you believe.
If he was using it medically and legally, I don't see a problem with this person as long as they stay straight during work. The laws are changing though. Many states are starting to legalize in some fashion.
Why not just admit drug use during the interview process? Just answer the questions honestly then let the company decide if they want to hire you or not. This could save money wasted in making people take tests.
