could Jacobs make daoc 2 without mythic?

I know ea holds the rights to daoc. But the IP is basically a liberal interpretation of arthurian legend and other folklore. No one holds the IP to right that. So couldn't jacobs make a new DAOC just change it up a little bit?

Jacobs lost a lot of street cred after WAR.
IMHO, you don't need a DAoC2, you can do a graphic revamp of the current game. It uses the same engine that Oblivion, Fallout 3 and a bunch of other titles including WAR.
