One man thinks that Lineage II is too much of a good thing and has brought a lawsuit against NCSoft claiming that the game made him "“unable to function independently in usual daily activities such as getting up, getting dressed, bathing or communicating with family and friends" according to a report at Wired.com. The Hawaii man, David Smallwood, is seeking unspecified damages and wrote in his complaint that he would not have "played if (he) knew (he) would become addicted to the game".
A federal judge has not summarily dismissed Smallwood's complaint which may yet lead to a trial in the coming months.
VirtualWorldsNews.com has also learned:
Smallwood's Lineage II accounts were banned from Lineage II for engaging in alleged grey market RMT activity, which is expressly forbidden by NCSoft's EULA. Smallwood claims he never engaged in RMT activity and that NCSoft banned his accounts negligently as part of a scheme to "force" Lineage II players to begin playing another NCSoft game, Aion, instead. Smallwood's suit argues that his addiction to Lineage II resulted in emotional distress, a three-week hospital stay, and an ongoing regimen of therapy three times per week.

What? I don't think you can become that addicted to the grind. Sure if he was pvping 24/7 then maybe, but in general a 3 week stay in a hospital because of lineage? It was my first mmo but I mean cmon. What the hell.
Everyone wants to pin their problems on someone else. Not only is the guy an addict, he is now a nutcase filing frivolous lawsuits. Reminds me of that woman who spilled McDonalds coffee on herself and then sued them. If you can't take responsibility for you own actions, you need psych help.
I have to agree, if the individual can't be responsible for his own life he needs to seek help.

Shouldn't he sue himself instead since he is the one to blame?
No one forced him to play his game. Therefor it is his fault.
If I drink too much vodka, do I sue Smirnoff? No, I stop drinking so much or I get help to stop, I don't blame someone else.
But that is the difference between normal people and morons, normal people take responsibilities for their own actions.
If the guy would have been 12 it would have been another matter, then it would be the parents fault instead but grown up should be able to take care of themselves.
I agree wholeheartedly with you.
Sov - you played lineage 2 for a long time, was it that addicting?
I am still playing L2 and I know that if I want I can't walk away at any moment, I don't because I enjoy spending time with the friends I have made. Spending 11 hours a day on a game, highly doubtful.
Anyways I have posted about this topic enough over at Massively, don't feel like getting into it here.
These type of stories always make me laugh just about as much as it probably makes the judge laugh.
An he will win 10kk $ b/c judjes are idiots sometimes.. =P
Sucks because the woman actually won that on a technicality - the coffee was supposedly way above the regular temperature, meaning she sustained worse burns on account of it. Still a stupid suit, though.
hmmm,
I would say that for a first time mmo player it was very addicting because of its novelty and because of the fantastic game play.
By fantastic game play I'm talking about huge open world, game play and wars driven by politics, crafting system that mattered, an economic system that encouraged relationships, trust, and actual trade between players.
Beautiful graphics, great sieges and er, etc.
But when it came time for me to go out with the girlfriend or friends or just do something else I had no problem shutting the game off.
I will say that I was caught up in the leveling game as I came to the game about a month and a half after launch so felt I had to catch up. There were a few evenings where I did stay up until 2 am to get my level. Keep in mind this was when getting to lvl 20 could take about a week. But I never called in sick to play or refused a social outing to play. I would have to schedule my social time to include sieges.
So it's a great game but I think this guy has issues.

What a smart judge.... not.
I didn't realize it was your 1st MMO, what a way to start out.
I do remember the long grind back in the beginning. However, my 1st MMO was Lineage 1 so as far as grind went it wasn't anything new to me. The only time i really specifically made time for the game was on siege weekends but that was the most fun part of the game.
Anyways, I agree this guy has some serious issues (4 weeks in the hospital because of a game? I mean come on dude).
People are missing out on some crucial points about that case.
He had recently had his accounts banned for illegally selling virtual goods. Which correlates well to the fact that if he was playing for that many hours every day he couldn't have a full time job, so he was clearly making his money by selling gold/items.
Basically they caught him, banned him, and he is now being a whiny baby about getting banned and losing his illegal job so now he wants to make them suffer for it while he gets some more money out of it.
Any decent judge/jury combo going forward will see right through this case and it will be tossed out quickly.
lol... just lol

i agree with this!
this guy is pathetic ((in the sotry))

Don't forget gets addicted to some heavy drug, like crack or heroin. Because, well if he can get that addicted to a game, then well, drug abuse may be inevitable. What a moron.
If this is even allowed to be brought to court then we, as in everyone of us, is in trouble. Next time:
Breaking News! George Middleman from Florida is suing The Coca Cola company for and I quote: "can't stop drinking this extremely addicting beverage and now I can't function without it".
The fact that he can't "function" without Lineage 2 is not NCSoft faults, they made a game he used it until it became an addiction.
What I find most disturbing is that this wasn't summarily thrown out upon filing.
¯\_(ツ)_/¯
The guy needs help NOW, plus being ridiculed at every possible moment for bringing such a ludicrous lawsuit.
However you never know, they made Mcdonalds put "Contains Hot Beverage" on coffee and tea to please the morons wandering planet Earth.
Don't you know? Blaming games for all your problems is still a viable tactic.
I can't believe the judge didn't throw out the case on filing either, although you know they must've been at least shaking their head at it.

LMAO!!! I agree he is probably just pissed off cause he got his accounts banned. I highly doubt he was addicted I honestly think he was just using that as a lame excuse to sue them & I have no doubt in my mind that this case will get thrown out of court. Lineage2 is a fun game & it can be a game ya wanna play every day but I never was addicted to it when I played it. I see it as I see most games I've played. Just a way to pass time & a nice distraction at that when I need one. It's for entertainment purposes only & that is it. When this case goes to trial he'll get laughed out of court. Cause he has no legal standing not considering he already got banned for illegal activity, no one will believe that he is addicted after that is brought up. Would be funny if after it's thrown out of court NCSoft countersues him. Then he'd actually have a job just not one he'll enjoy LMAO community service would serve him right.
if he knew they were addicting he wouldnt have played them? in this day & age?

the argument that people didnt know smoking was dangerous could have held up in the 1950s and 60s but nowadays the info is out there that it's dangerous and risky.
not that it's a 100% direct parallel but the same idea applies.

Jesus... I'm still longing for the MMO that will make me want to spend 11 hours per day on average for years upon years... and this guy found it... in L2 of all MMOs. I lasted less than a week in that MMO before I walked away shaking my head. I'm almost jealous of that poor idiot. Almost.
