I actually prefer free for all over faction-based with the caveat that there are a few safesones that are safe for everyone. I'm a huge Eve fan and I think that Eve managed to make PvP right. Didn't matter what your race is. If you are in high security space, and not at war with someone, then you were effectively safe (sure you could be attacked, but with asset destruction the penalty, and assets actually costing something to acquire, it's an extremely rare occurance for most players). But if you were in Low security space you were pretty much a free target. I'd want to hope that Archeage has a pvp system similiar to this, as opposed to one similar to Darkfall where it's PvP everywhere and the penalty for attacking someone is so tiny that there might as well be no penalty at all.

Rivaling nations will be fairgame, allied nations will be no no, same-nation will depend on ruleset and so on. So it can end up 2faction, three faction, 545458 faction game all depending on player diplomacy(sort of more advanced eve version of corporations)
I'm glad they made it FFA during CBT3. We'll have to see what they do about server types and rulesets come official release though. They are marketing the game as though it's for everyone and in my opinion it would be foolish to turn away a segment of people that will be attracted to AA for it's freedom of play.
For me if you're gonna have a PvP game it needs to be FFA but with some kind of penatly for ganking. People have to have something causing them to think twice about ganking that level 5 when they are level 20 or even worse level 50 and ganking hoards of level 5s. At the same time if they want to take that risk of ganking the level 5 why not let? People would "go red" in L2 all the time and if that was a risk they were willing to take they should be able to take it.
Faction PvP has always bugged me, mostly for one simple reason. It limits you from races or classes that you want to be apart of. I hated that when I tried out WoW all my friends were horde, and I didn't want to be horde but had to or I wouldn't be able to play with them. Same thing happened in DAoC, and Aion. With DAoC there were 4 of us I wanted midgard, 2 want hibernia, and one wanted Albion. So guess what me and the guy wanting albion were stuck with hibernia.
When a game is FFA though you can be any race, any class, and start anywhere in the game and still be in the same guild as all your buddies. To be completely honest that is a good enough reason for me to not like faction style PvP games unless there's the off chance that all my friends want the same faction, which has never happened. AA has hinted that even if you start as one faction though the option to move to another will be possible, that's a nice easy way of fixing that problem kudos to you.
You make a great point and personally I would go for FFA with a penalty. I would take a 1/2 hour in jail to silence the annoying troll in general chat. There was mention of a way to swap factions which is nice. I would like to hear more about player made factions and their relationship with the main two. Could you treaty with both and other player made factione to be "nuetral"? Wouldn't make you immune to FFA but would impose penalties to anyone that ganked you. Then again you couldn't do battlegrounds either I would guess. AA just brings so much to the table I hope as many people play as possible.

However yes, ocean is pretty much eve-like space. Everyone is a fair game and if you decide to build a base in some unmapped island in the middle of ocean and take up piracy, you can
