General: Fallout Online: Bethesda's Appeal Rejected

Bethesda has been handed another setback in its ongoing battle with Interplay over the development of Fallout Online. Bethesda was disappointed in September when a temporary injunction was denied. The company filed an appeal which has now also been rejected.

A point of contention for Bethesda is Interplay's financial stability, and whether the company would be able to pay any applicable damages should it prove successful in halting the MMO's production.

The source of the dispute is in the particulars of the $5.75 million deal for the Fallout license in April 2007. Bethesda agreed that the rights for an online Fallout game would remain with Interplay on the condition that "full scale development" should start with at least $30 million in funding within two years.

    Kind of ridiculous if you ask me, Bethesda has no experience making MMO's to start with and the market has already shown that there is limited interest in such a themed MMO since there are already several on the market.

    Theres not enough imo....More choices for the people that like Post Apoc / Scifi mmorpgs the better.

     

    I for one would purchase a Fallout Online.

    Just wonderful  another MMO that will take 5 year too make , and it will never make it to market, they might as well give up now and spare us the disappointment.

    Well we had fallen earth, but it has turned into such a joke, I would welcom interplay making it.

    Bethesda is hardly renowned for it's bug free games either, and Fallout 1 & Fallout 2 were better games the only thing they have going against them is time.

    Ass if fallout 3 was not,  man that game use to crash until they got with nvidia to fix the driver issues.  Fallout 3 with its bugged update process that folks had to work around to get it to patch.  Falout Las Vegas was much better.

    I dont really care who makes it, Or which comany is more "professonal" But from memory, Interplay never patched Fallout 1, It fell to the community to make Patches and hacks to make it playable.. so thats a -1 to interplay in my book.

     

    Please correct me if im wrong, Memory does fail me on occasion

    Bethesda seems to be losing all of their cases.  Glad about this one though.

    Cannot express how happy I am about this announcement. Bethesda BUTCHERED the Fallout universe with Fallout 3. It was NOTHING like its previous incarnations because Bethesda cuddled the game up for children to play on consoles.

     

    Fallout 1 & 2 were the best out of the entire series, and Interplay would be hard pressed to do worse. Hell, they could even do a top-down playing MMORPG similar to how Fallout2 was played from an Aerial view and STILL do better than what Bethesda did with Fallout 3 & "New Veggies".

     

    Besides, the ONLY "Post Apocalyptic" MMO's on the market are Fallen Earth & Face of Mankind. Both of whom are a joke, and were never what they should have been. 

     

    Oh, and S.T.A.K.E.R Online is coming along rather nicely according to what I saw from the Russian Open Beta server. Problem is I can't read russian so it's nearly impossible to progress past the first 5hours of the game :(. Still holding out for an english language pack to show up on google someday :'(!

    There is massive interest if it's well done. The ones currently out there are utter shit. Fantasy is awesome and all, but would be nice to have a "good" sci-fi mmo... and I'm not even picky about what sci-fi at this point... just something that doesn't control like ass and has interesting gameplay and story.

    As far as interplay and bethesda... shrug. They both made games I greatly enjoyed, both released them buggy as hell, and honestly... long as they get the right talent on board and get the bugs fixed up reasonably well and maintain the feel of the world... I'm all for it.

    Edit: honestly... most genres except fantasy are completely barren and suck, the heros genre has coh which is far better than any of the other alternatives but lacks the polish or future of many fantasy games. Horror is hard to do in an mmo and mostly ignored, sci-fi is a dead fetus aborted before its time by star wars galaxies cu/nge and general design being of non-interest to most, fallen earth had potential but its so klunky its about unplayable, etc... desperately need some themes other than fantasy and not just of the reskin variety.

    It's sad to see this going on as it only delays the MMO and hurts the player bases clamoring for a game like this. Bethesda need to stop sueing as theve lost 2 in a row now.

    Fallout 1 and 2 were classics. Fallout 3 was ok but felt lacking and new vegas sucked as too much was crammed into a small area.

    They can continue to develop the game if they wish, but they still can't release it without Bethesda's blessing.  Which means:  You're not going to be playing Fallout Online anytime soon.

    I think that wa the case with FO 2 but not with 1... But not sure, so long ago and memory does indeed fail.

     

    Still, I agree with many here saying FO 1 & 2 were classics and FO 3, while good, wasn't the same.

    I couldn't possibly disagree more.   I found Fallout 3 way more fun than it's predecessors.   And I'm old school enough to remember playing ASCII graphic games, so that wasn't the issue.

    First off Bethesda single player RPG games would make better MMO's than 99% of MMO's on the market.  Most true MMO fans have been hoping and praying they would take the next logical step into MMOG's.  Secondly Fallout is one of the most sucsessful games ever in terms of sales so I think there is atually a huge market out there for a game of this genere done right.

    Stalker had more bugs than FO3 ever did! Not to mention its terrible performance issues at launch.  Also, New Vegas was made by Obsidian, not Bethesda.  And New Vegas was more buggy than FO3 imo.  But I didnt like New Vegas as much because the "moral" choices were very unclear as to which choice affects what.

    Obsidian doesnt have that great of a history though, KOTOR2 which many say isnt as good as KOTOR1 as well as Dungeon Seige 3 which may say isnt that great either.

    All that said, I dont think Bethesda should make MMO's because I just dont think thats their field.  Just like I dont think Bioware should be making MMOs and instead should be focusing on not making copy paste SPRPG full of tunnels.

    I think Bethesda should make the MMO version of the game. They have more resources and F3, Oblivion and F3-vegas was very good sandbox RPGs pretty much I can imagine thouse switched to MMO.

    I really don't think a Fallout Online will ever see the light of the day.  There was a deal that was made when Bethesda bought the rights to Fallout, that interplay could continue to develop a "Fallout Online" (codemaned Project V13) game that it was working on when the rights were exchanged.  Bethesda only agreed to this if Interplay could do this in a reasonable amount of time.  Interplay filed paperwork to start making this game in 2006.   Bethesda bought the rights in April 2007.

    They did nothing for two years, until they "joined" with Mastehead Studiios in 2009.  Masthead Studios is supposedly funding most of the project as well as creating the engine.  I am not certain, but it's most likely the same GOD AWFUL game engine that was used in the major flop Earthrise.  Yep, same people who made Earthrise are making Fallout Online.   I don't imagine Masthead is doing very well financially at the moment, and Interplay is always teetering on bankruptcy. 

    So five years ago they started working on the game.  They have absolutely nothing to show for it, except some teaser website, an ongoing legal dispute, and a partner in Masthead Studios.  Would love to play this game, but to be honest, I don't want any of these companies doing it.  Two are highly incompentent and Bethesda games, while I love them death, are always riddled with bugs.   Who knows, maybe one we will see it :D

    Woot.  I doubt that infinity will get it done but I would rather play a fallout mmo made by them then that horrible FO3(dumbest main plot EVER).

     

    Now with that said I do agree that if bethesda wanted to they could make great mmos(their games are already damn close).

    I will not play a game with a cash shop ever again. A dev job should be to make the game better not make me pay so it sucks less.
