Merlin is probably better for most missions, because it has a diversity of guns and missiles, while the kestrel is all missiles. The Kestrel, on the other hand, is a powerful, cheap PvP frigate because of its missile configuration, and it also has one of the largest cargoholds of all frigates, making it useful for some of the cargo missions that require higher volumes to be transported (bigger than what the merlin can hold).
Unless you have our missile skills set pretty good already I would go for the Merlin, but your not really giving us alot of info to base the choices off of.

Was my first upgrade too, and I still have it even though I have muc better now just for sentimental value. I mined a lot of ore with that ship.

Actually, I own both. I'm a missile guy though so I've never gotten around to properly fitting the Merlin. The Merlin is certainly a fine ship. The stats are good. Just hard even at the intermediate level to major in both missiles and guns given the leveling time.
Another option is to hot rod the fast caldari frigate (is it the condor?). I've thought about that for small but lengthy errands.
This issue is really what makes Eve fun for me. Choosing a ship, fitting it, and then salivating over what other ships you can own, use, or even lose!

I actually like the merlin better - but i have lots of gunnery skills never liked missiles so much.
merlin - more for npc killing and missions but kestler is better for pvp

yes - but from other hand if you have better guns skills merlin is better even for pvp :P

Got the merlin... equipped with 2 launchers and 2x 125mm railguns.. doing pretty fine right now =]
