I don't know how the NCsoft lawsuit is going in NA. But over in Korea the case made it's way all the way to the Supreme Court of Korea.
The Supreme Court of Korea finally came down with a decision yesterday and decided that BHS itself was not guilty of any charges or wrongdoings.
But charged YH PARK (former TERA's executive director, who stepped down last Aug.) and two other former NCSOFT Employees of Leaking Corporate trade secrets, and each have to pay 2 billion won each in restitution to NCsoft, and will now face criminal charges. Criminal charge sentencing will be held at a later date.
This is the final decision of the Korean supreme court.

Wow that went through pretty fast, well thanks for the information, i guess this solve the whole lawsuit issue. If it rule like that in Korea highly doubt they get anything out of EME.

That doesn't bode well for the NA lawsuit then. It means they aren't blaming BHS for the theft of the material but have decided it was indeed stolen and has gone after those that stole it.
With the NA lawsuit things have a good chance of going south for BHS with patent and copyright infringment being such a hot button issue lately.

Well Tera was kinda saved in Korea even thought NCsoft was right about their accusations.
I guess everyone is kinda happy.
Not really because the people who did the crime, is already been charged. EME was not part of this at all thus the suit against EME goes no where.
However it is on the indiviuals so doesn't effect the company.
There were multiple lawsuits, the above was for the Korean lawsuit I was reffering to what could happen with the NA lawsuit. . At the end of the day it seems BHS is using stolen intellectual property.
Think to yourself whats been going on over here on this side of the globe. SOPA, PIPA, extreme fines and punishments for patent/copyright infringement, even going so far as to go over seas and do busts in regards to this using military resources and personal.
So yes this really does have a chance of going bad. You could be looking at no NA TERA or a short lived one.
I'm not saying that this will happen, I'm simply saying it's a likely possibility. Saying no not really doesn't make much sense.
No not really, because the charges were these 3 specficly leaking "Leaking Corporate trade secrets". Nothing to do with the game or the content it self. And all these "trade secrets" hardware and software were long returned to NCSoft last year. So there is no reason at all to sue EME.
And SOPA and PIPA were so horribly written its not even funny who came up with that crap -.- I doubt it was even something made to really go against praicy, as some retarded politiction who isn't even connected to the world try to do something they though was "right" and FYI this side of the globe though both of them were retarded -.-
How badly SOPA and PIPA were written is exactly the point, this gives you an idea about the type of individuals will be deciding the fate of these lawsuits.

If the charges are laid at individuals and not the company as a whole and from what I can work out 1-3 individuals then the company is safe imho. This will probably be the legal standard across the world now as legal references should be allowed.
Apparently the company was only started because those that left NCSoft were fed up with their treatment as employee's. And from what I have witnessed living in Asia, asians have quite a bit of patience...
Lesson: Don't treat your employee's like Xrap otherwise you may not have employee's and they will take what they have learnt elsewhere.

Patent issues over patents which have never been filed in the US. I don't see how a US court is going to justify making a ruling based on that since it would involve having to recognize the validity of foreign patents - Which is one of the core issues of the patent/copyright situation of today.
NCSoft is getting diddly squat in the US, even if the Korean Supreme Court decided otherwise.

First, BHS controls the NA version of tera as well, en masse is just the publisher, they trasnlate and distribute, they do nothing else.
ANd second, American supreme court could give 2 fucks about what a korean court rules. Win or lose in korea, it would have no bearing in american courts.

It may sound odd at first, but it's actually true.
The US is making up all these laws (sopa/pipa/cispa) to protect it's own industry. The core reason behind the submissions is that the US thinks foreigners are stealing their stuff.
Consider this: What would the US say if, for example, Apple sues a Chinese company for patent infringement if the latter company has a similar patent over in China?
Economically the US can't afford to get angry about this since China pretty much funds their economy at the moment, but it's this exact thing they want to counteract with the new laws - ACTA in front. It's to force the US copyright and patent system on the rest of the world, not to accept it in their own country.
If a Chinese company would sue an American company for patent issues following Chinese patent law, a US judge would dismiss it straight away because it's patents outside of the US.
Apple for example is having a lot of trouble in copyright and patent lawsuits outside of the US. ACTA would make this trivial by enforcing "appropriate protection of IP" regardless of where the lawsuit is held and what patents of what country are actually valid. By ACTA's current revision, every country would be forced to recognize the 'rights' of US companies and the US patent office. However, since the US isn't actually participating in ACTA itself it has no such responsibility.

What happens if they lose in the US? Does that mean anyone who buys a copy of TERA is buying pirated/stolen goods? Will you get a refund if TERA is shut down like a pirate site? Seems awfully risky given the current insanity over IP in the US. Let's hope this gets shot down quickly and doesn't drag on for long.
No they just get charged for it. Because not the entire thign is pirated, now like NCSoft made the entire game than BHS took the game and released as their own. Only certain elements were "stolen" so its basically just a fine.
China funding the U.S. economy? They own less than 10% of the U.S. debt. The largest owners of U.S. debt is...well the U.S. as weird as that sounds. The social security trust fund owns the most debt at 3 trillion dollars or about 22 percent, and the Federal Reserve has another 2 billion. So no, us Americans use financial trickery to fund our own debt:).

The Korean court decision may not hold legal precedence, but it may have an impact.
It's mostly West vs East on this point, if anything. The US is definately the biggest player in this though, it has been ever since this whole mess started in the 90's. China's current policies have veered away from a pure protectorate economy to a more international one in the last 20 years, which has prompted them to get involved in this, albeit more recently - The US leveraged it's stronger position around 2000 in cases like these, prompting the Chinese response.
That said, copyright/patent cases are running rampant across the globe. The sad thing however is that a lot of them are backed or initiated by US companies, taking Australia as a shining example of this. Every single copyright case there has been 'mysteriously' backed by both the MPAA and RIAA. Coincidence? I don't think so ;p
The US are digging their own grave on this i think. The kneejerk reaction to the internet explosion in the mid 90's still hasn't stopped spasming around for attention and a bid to regain control. The RIAA and MPAA seriously believed that the internet was just a rage which would blow over in a couple of years, they still do!
