The people calling ESO shady for pre-orders with NDA, here is a prime example of a MMO who has done this

Yes, the NDA was lifted in Beta phase 3 but the pre-orders went 20 days before it (i.e. NDA still in effect but game available for purchase) and yet the game was conceived by the MMO Community like the second coming of old school MMOs. Where was all the criticism then? And this example is just from the top of my head. I am sure there will be others who have done this as well.

with all the post about not continue to sub. i had a feeling that it running based on fans base.
ESO will does the same.
they already able to sell the game twice arent they? even CE , they had 2 of it , 1 from 1.0 and 1 from ARR. lol
in comparision, i actualy love the Miqo'te than imperial. those hot cat chick with short skirt. lol
but i still think zenimax a bit greedy when they selling box + sub + cashop that what make people angry.
but only people who care about the game will post. people who already leave , they wont even talk at all.
Trying to sell a product at a premium to a uninformed customer, is the epitome of a company who knows their product is sub par and is trying to recoup costs before a backlash.
There is no other way to cut it.
If they thought their game was fantastic, they would have have dropped the NDA and showed everyone how awesome it is to drive sales. But instead, they have chosen to be as deceptive as possible while staying within the bounds of consumer law.
And no, your hurr durr of its still beta is invalid. The game as it stands today is 99% what you will get on launch day.
The reason it's shady is because their complete change of heart to bait more players. On one day they went back on two features they had defended to tooth and nail.
1. Faction Pride, something Matt Firor always referred to whenever someone asked him about if the races could enter any faction. Or would ever be able to. Because it was important to them.
2. Paygates, they defended their subscriptions by saying that they do not want us to ever have to stop and feel like we need to purchase extra content. In this case its the Imperial Race, a rather popular race.
Not to mention how borderline P2W their Imperial Edition. Skipping content by purchasing a horse and two rings that grants you extra XP for real money is very P2W. Not because you win, but because get a headstart. An advantage over others who do not spend money.
But it's not even exclusive. You can purchase that edition if you get tired of grinding for a horse midgame, then you can head into their store and purchase a goddamn horse, transformable armour, Rings of Mara for extra XP.
It needs to be a non-tolerance zone. You either go full subscription with no Cash Shop or you don't go subscription. WoW has one, but they're ancient. They can get away with it. And, they are fair about it. They're not selling goddamn races. And don't compare it with Expansions. Expansions contains other content than races.
and thats why ppl should not fall into these pre-orders with NDA on, if the game is pre-order it should be pretty much done but they want your money so much they make games pre-order in crappy alpha phase without a good testing and then you have to alpha test it for them and they say they made it pre-order because they care for people(or other untrue reason) , paying for testing and that is why these games mostly fail, are a big disappointment, from getting payed to alpha test something people now pay to alpha test
I love how people hink its their right to tell these companies what to do with their products. Its simple Its their game... they can do with it as they wish. If you dislike a policy or something about a games development cycle.. then it is very simple, don't support it. Just for geessh sake, stop complaining constantly about it. People crying game "a" is this or that , game " b" was this.. it doesn't matter, its their game to either make a hit out of it, or to nose dive it. and you have two choices, either support it ( with you pocketbook) or not too!
Me personally, I like it when a game company has a nda close til release, cause i hate hearing all about how super guy x thinks its a bad game, cause it doesn't have a stuff to his liking, and thus he makes it his mission to one man crusade against the game, ruining it for everyone else. I like to get into a game for me, not because of what others might think or not think. Thats the problem in the genre now, everyone wants to be a blind sheep and be hand led around a game, grow a pair try a game out for yourself, make up your own mind! If its not your cup of tea then move on...
So you actually like to buy non refundable products at a premium price that you know very little about, even to the point where you dont even know if you will like it and be happy with the purchase?
Another way to look at it is... I have been married now for 23 years.
With that said.. the first 3-5 years, i constantly complained about my wife cooked this, cooked that, didn't tell me whats for dinner before hand... used this type of meat, when she should have used that. you know just complained. Guess what happened... she stopped cooking and from year 5 til 9 either I either cooked for myself, or i went hungry. I have since learned unless i plan on cooking the meal, stfu and eat it, and guess what? trying new things didn't kill me, it actually made me like new things
So dislike how a company has made, marketed, priced their game??? Make your own game or stfu and try to enjoy what you can... and if you can't just stfu
so what your saying is pay for a game, test it and if you dont like it or its crap move on but you payed for the game and since it has an NDA you cant tell others, show them vids of the crap that game is, "brilliant thinking" there (just in case you really are a "brilliant thinker" i'm ironic)
If you aren't sure whether or not you want the game then don't pre-order. It's only meant for people that know they want it.
Not everyone needs to know everything about a game to decide if they'll like it.
For those that will be playing the game regardless, it is no big deal. For those that want to wait till the NDA goes down, they can wait. If the NDA goes down before the launch date, then people can buy it the day before with no NDA in effect and then there is no issue. We will see when the NDA goes down. There is supposed to be an open beta, so it will be down when that happens. Why is this an issue again?
How many people long for that "past, simpler, and better world," I wonder, without ever recognizing the truth that perhaps it was they who were simpler and better, and not the world about them?

Honestly I would wait before buying the game based off everything I hear and know the game is likely going to be a failure.
The game is under NDA so disclosure of the actual game information isn't permitted but before you buy the game I encourage you to look at all the videos they post here.

If you look at all their videos you see how the game looks, and how the class/weapon system works if you are okay with that kind of game then yes good game for you but if you are like me tired of the world of warcraft style play then the game is a let-down.
Just look at the videos before you buy which they have posted there I won't be buying until the game is changed/upgraded to feel more like Elder Scrolls, and Kingdoms of Amalur which btw KOA is a good RPG game I wish it were in MMO style where you could play with others in an online world a game designed like that would make a great title.

Difference is, that we're paying for their game. You weren't paying for the work she put into the meals. She didn't ask you to shell out 20 bucks if you wanted "exclusive" gravy on your goddamned potatoes, so to speak.
Cash shops in subscription games have been done before too.

Just because something has been done before, doesn't make it alright. Most games that launched pre-orders before NDA dropped had something to hide, usually a shallow end game.
your case is not apply here b/c you need what your wife make so she doesnt has to listen to you.
however, i'm sure ESO need our money. so we have the right to complain to make thing better. and it they dont, we go separate ways.
also in process of making law and regulation. first they introduce and vote for it, and then they regulate it for some years to listen to people complain and if everything ok they make it become LAW. so i believe complaining is important if you want thing better in future.

But your post made me think. perhaps if a few more people got burned by a bad game ( nobody likes getting burned by a bad game .. ) then as a group of game players, we would start being more careful of where we put our collective money. and the crap by night developers wouldn't actually start making a good game. Now do I want to rely on game player x and his distorted views about a game, for me making up my mind about whats a good game?? NO i do not.
One game that comes to mind.. Asherons Call, everyone banged that game... it sucked it was this or that and ohh it was soo bad.. in my honest opinion it was one of the best games period. Its still going ...
Do you want game companies to try new things?? do you want the genre to be fun again?? then relying on player x to tell you before a game actually comes out, what/ how a game is , only makes developers "play it safe" , and thats something I am tired of... I will support every game coming out trying to do something new, something other than WoW or other than what the blind masses, that are being told by a small group of players that dislike something. If a game company wants to keep the lid tight on their product then so be it... if i am on the fence about something, then i wait, if its something new... whats 60 bucks ?? I piss that away in beer weekly... the world will survive
Looking at videos is nice, but it's much easier to make a decision after actually playing the game. So right now I would say waiting for open beta would probably be the smart bet. Though, chances are with this CE cash grab it means the high level content is in real trouble, which conveniently won't be available in open beta, not that most people could level fast enough to get a feel for it anyway.
I do not believe that having it been done before is any justification for the continued use of this practice. Lifting the NDA will allow people a better view of your product, which will allow smarter consumers when it comes to purchasing a product. You are using some very faulty logic in order to discredit those who are unhappy when a company opens up their game for purchase without giving people knowledge of its systems by pointing the finger at others.
This is an uncouth attempt at discussion and has no real application to the fact that ESO is selling its game while you cannot preview it unless Zenimax gives you permission through their Beta (not counting leaks and such). This is not a benefit to the consumer and should be discouraged from a consumer perspective. A dubious practice is not made less dubious simply because the person across the room engages in similar activity. Each instance needs to be understood for what it is and there is no need to try and direct the blame away from your favored game.
Thing are pretty simple, this is just personal choices and bussiness
ask your self: will you pay for the pizza without opening the box and check? it might not be the pizza you want, it might be outdated. it might have finger nail in it. so many things could happen when you lack of information.
ESO can keep its NDA , its their choice. however, as for me, i'm not blindly throw away my hard-earned money. to some people it might be small. but i know i work for that money and i want the best out of it.

When publishers hide behind a veil of lawsuits, in itself tells you...bypass.
For if the game has problems but they still want $$ for it, maybe gamers need some consumer lemon law protections for games, then.
Hide behind NDAs, gamers will be enforced with lemon laws.

End game is shallow because end game for a MMORPG is a oxymoron because its not suppose to end. No more levels no more quests well other than dailies which is same old crap I already have done to many times. Oh or my favorite grind out meaningless rep and do raids. Then their is pvp oh what fun that is. Why are these the only ideas for end game these ideas are old. themepark and sandbox are like peanut butter and chocolate put them together in the right mounts and you got a tastey reeses cup of badassness.
As for the preorder with the NDA still on who cares really. You know damn well they will offer a upgrade that includes all the stuff from the best edition. So its not like your getting screwed. I think this is more for the beta testers who have played the game and liked it to jump in and support the game with money.
Also to those that have not played ESO its not a WoW clone it's Elderscrolls game with other people sharing the world with some MMO elements mixed in. Those MMO elements did change some of the mechanics and making PVP end game is why they made classes and didnt give you the complete freedom of the single player Elder scrolls games cause of the almighty balance needed for PVP.
I am confused. If you are so sure that game is not worthy of your attention, why you are still talking about it?
