Effectivly the only company right now who could do that is Relic since they have the game rights to the 40k license. I my self think it could work very well if done properly.
Check out the posts in the Warhammer Online forums, we've been discussing this a lot.
The main thing about it is, like Solanar said, 40k games are in the plentiful right now (Firewarrior, Dawn of War + Expansion). Comparatively, a fantasy game hasn't been made for many years, and most game retailers don't even carry those that were made anymore.
There are also complications when creating a 40k MMORPG. Its natural way of playing should make it an MMOFPS, but since close combat is a key role for some races (Orks, Tyranids, etc.) this would limit the playable races to a few. Also, fantasy fits the MMORPG "Archetype" and should make a good game.
Don't get me wrong though, if they made a 40k MMORPG I would buy it in an instant, but I wouldn't expect to see one on shelves for at least 4 years.
The problem with the Fantasy Warhammer is that it is nothing really new. They stated it will be very RvR heavy(not pvp) and with realms.Honetsly i will play it but it is still the same MMO generation as DAOC is at the moment.
