Should i contact a lawyer?

I used to play shadowbane. 2  years ago. I cancelled my subscription about 2 years ago, and realised LAST summer (like the one before this one) that i was still being billed. So i went and cancelled AGAIN. Then a few months back i was checkign my visa bill, and what do you know, shadowbane is on there again. SO i cancelled for a 3rd time.

 

Today, i get an email saying my visa is going to expire next month and if i want to continue my subscription i should update my visa. I check my visa bill and i am still getting charged.

So, i cancelled for a 4th time today. Never having once re-subscribed.  The way i see it , they owe me about 200 bucks for all the months they have charged me. Should i contact a lawyer?

    If you have cancelled your sub even once and they are still charging you then thats basically theft. If you want to see them spring into action Bro dont call a lawyer... call the cops. image

    I checked my subscription history... and apparently (even though i haven't logged in since 2004), i requested monthly payments instead of annual payments in summer 2005 (like 6 months ago).

    Now, how does a person request a billing change when he hasnt' even logged into his account in over a year?

    /baffle

     

    I tried contacting them but their customer service is completely useless.

    Send their CS an angry e-mail threatening to take action, if then they take no action then contact a lawyer. The thing to remember though is that there may be alternate reasons why you are still being charged that is out of the control of the company. For example is there a chance that your account is in use by someone else or it may have been hacked/stolen and someone is renewing the accounts monthly fee's. I don't know their payment/ security methods so I dont know if this is possible.

    But definitely check what is going on and see if they will refund your money. If they don't take action then you should probably consider a lawyer/ contacting the bureau of business in your area.

    Yes, it probably is their fault that this happened, but you really didn't help the situation by not emailing them before this point in time.

    Anyways, by getting a lawyer you would probably spend much more money paying them, then you would get from ubisoft.

    Just try to get your money back through emailing their customer service. It may take a while, but they usually give you your money back. Hopefully they can check to confirm that the last time you logged into the game was indeed 2004.

    dude listen to me!! First of all get all ur figures right.. when u started paying when u stopped and all the dates etc! once u got them call a lawyer see wat they say.. if they say call cops then call cops if u dont need to call cops and can do it through lawyer then do it like that!

    make sure u got all the facts etc not just "yeah i cancled" then u have a case.. e.g.

    wat sounds better:

    "yeah man i cancled but they kept charging me"

    or

    "on the 25th of april 2005 i started playing a game called Shadowbane found at shadowbane.com paying $15 a month i cancled my payment on october the 3rd and Shadobane studios kept charging me $15 for 7 moths more"

    ok im guessing prices and dates but u get my drift ;)

    after the first time they started charging again, I would have called my CC company and told them it was a fradulent charge.

    Hi smaku -

    I work in the financial services industry.  Here's what your rights are in this situation: You have 60 days from the statement mailing date to dispute any charges that you feel are either fraudulant or in error.  After 60 days, you are legally considered to have agreed to any charges listed on your statement.  At the most, you'll be able to get the last two months worth of charges if you're still being billed monthly.  If that's the case, what you need to do is contact your credit card company immediately and file a dispute.  You should also have a new number/card issued to prevent future charges.  After you do this, your credit card has 10 days to post a conditional credit to your account and Wolfpack has 30 days to prove you didn't cancel your subscription.

    Same thing happened with me for EQ2, luckely they stopped charging after I cancelled for the second time, so it "only" cost me 45 euro. Which is still a lot for a teenager.

    Yep, forget the lawyer, that will be far more trouble than it's worth. Talk to your credit card company, they will be far more helpful. On a couple of occassions when I had false items come across my card they immediately refunded me, no questions asked, and made damn sure that that was the end of it.

    these guys make a business of getting you to use your card hassle free, they take it seriously when guys try to screw you when you use your card.

    The race doesn't always go to the swiftest, nor the battle to the strongest, but that's the way to bet.

    Agree.  Contact your cc company, they will sort it out for you.

    CC companies don't really need lawyers.

    I had a similar problem with a Mercury/Fileshack acct. I cancelled, and they did cancel me but when another company took them over they automatically reinstated all the cancelled accts and started billing people. It took me a couple phone calls to my cc company and that Fileshack place but it did get sorted out.

    If you have the cancellation email or any proof like that print it and send it to your cc company or email it to the Shadowbane support people. They can easily see you haven't logged into the game or your acct. That is one way Fileshack found out I wasn't actively using my acct there.

    2 things. do BOTH asap!

    1) Contact customer support and find out when the last time the account was logged into was.  They should be able to tell you.  I know both SOE and Mythic can tell you to the minute when you last logged in if you ask.  If they CAN't answer then they have big problems from an accountability standpoint.  This will support your case that you cancelled ages ago and they may even reverse the charges for you.

    If that fails then proceed to step 2 (you may decide to do step 2 even if they say they're fixing it, up to you).

    2) Call your CC and tell them you have been erroneously billed for the past 2 years.  I'd highly recommend that you provide them with the original confirmation number and date from your first cancellation.  They may not ask for it but if they do you will want to have that info.

    3) Relax, sit back, and enjoy the huge CC refund you will be getting :)

    Best thing to do is make sure it is cancelled first, preferably by phone.  Then contact your CC let them know what's going on.

    Email, hell! After I phoned in a cancellation and they're still charging me, my next communication would be *registered mail with return receipt* informing them that they are to stop charging me *immediately* and refund the mistaken charge, or my next communication with them will be from my attorney. I would also give serious though to instructing my credit card company to refuse any further attempts by them to charge my card.
