Can/Should Backers Sue Derek Smart for Project Endangerment?

With Derek Smart continually harassing CIG and either threatening Legal entanglements or actually moving to bring them to bear....CIG will no doubt have to divert attention from their project to deal with him. They will lose both project time and backer dollars dealing with the man, putting the overall project at Risk.
Should this happen, would the Backers have any legal recourse?
Put simply, Derek Smart's behavior may be a potential endangerment to the financial investment of almost a million Backers. Speaking hypothetically, can the backers pre-emptively bring a class-action suit against Smart for endangering their investment in Star Citizen.

I hope not! Honestly, if anything, I think that the Line of Defence MMO backers should create a class action lawsuit since he is obviously more focused on seeing to the failure of SC than he is creating the game he promised he'd deliver with LoD.

Here we go again with the same misunderstanding that appears in every other thread on this same topic. Kickstarter backers are not investors! They are neither entitled to anything, nor have anything endangered. Their money was a gift, given to the project developers in order to encourage the developer's creative process.
If someone is interested in truly being an investor, they would provide the kind of money that pays for years of salary, office space, hardware, software, etc. which would enable the developer to complete a product, hopefully make a profit, and repay the investor. Even at the highest tiers, a single Kickstarter backer isn't going to pay a month's salary for a single person on the team, and they aren't going to be repaid when the project is completed.
There is nothing Derek Smart or anyone else who gave their money to this or any Kickstarter project can do if the project succeeds or if it doesn't.
But do realize, you've "invested" nothing in this title, you have "donated" your money to it and have little recourse if nothing comes from it.

Think of it another way. You through an epic party. Rent a warehouse, hire DJ's, bartenders, the works...shell out a small fortune.
A whole slew of people show, pay a few bucks to help cover the costs and have one. One guy shows up and goes full-retard. punches a DJ, sets fire to the bar, pisses on the food lmao whatever. He paid cash to be there, just like everyone else. EVERYONE night is ruined. Is this really so different?
BTW, I am asking hypothetical questions. I've backed SC, but barely enough to constitute a discount bin purchase. I know some people went just effing nuts and shelled out thousands. That logic defies me, but to each their own.
