Yeah but you still need to buy Bethesda's game in order to install the mods. This case is closer to something like "lets mod their game and sell it as our own" type of thing. The resemblance is uncanny.

You could take screenshots from Hustle Castle, and put all 3 up side by side and they would be just as similar. Everything they claim, from the 3D rooms, perspective shifts, and character placements in the rooms is all the same in Hustle Castle (and other games as well). The rest, things like the "icons" that are the same but changed.... well isnt that everything in this world? Thats like saying 2 books are the same because they both contain words, just put into different orders.
Like I said, code is code, and it will speak for itself. If the code is the same, then fine. But having slightly similar features doesnt make it the same game with a new skin. The actual lines of code used to create those features would have to be proven to be exactly the same for this to go any farther than it is, and from what we have seen so far, there is no reason WB would even need to settle. Bethesda wont get a dime, if those screenshots and exhibits are all they have to go on.

No. In the software world there is a huge difference. It's not even considered in the same realm. WB and its partner used code directly from Bethesda without permission. On the other hand Bethesda markets to a gaming community that likes to mod games. Making the comparison is false and misrepresents what is happening. This isn't even akin to open source applications receiving code commits from non-team members.
One is using code in their core app and the other is allowing modifications of ancillary files but not modifying the core code base. Software licensing, what you can attach, and what you can't, and how is covered in the license.

I would agree that UI being similar and the similar 3D environment with cartoonish 2D character models is not much to go on for them, or anyone for that matter, but the 'bug' they mention during the demo gives them a leg; maybe a couple. If whats stated is true, it being fixed prerelease but post source, then there is no possible way behavior could possibly code the same error unless they copied in some way the original source code Bethesda has copyrighted their own intellectual property. Unless of course behavior just doesnt learn from their own mistakes and implemented the exact code defect in FS opening demonstration.

Personally, if I were making a mod, I wouldn't go into it concerned about compensation. Likely, my reasoning would be to impart a perceived improvement or remove a perceived deficiency in the game. If I shared the mod, kind comments and downloads would be all the compensation I would need.

Isn't the game hustle castle not much or no different then Fallout Shelter? It seems pretty trivial at this point to sue over similar game play. If that was the case no game company would be able to put out anything because everyone would just be suing for likeness. Good luck dark souls esq games.

Godfred's tomb - this is just a secret area I hope people will find. I've posted a few pictures in other threads. In any case, so much work has gone into it that, even though it's just a present for a friend, I decided to upload it when it was finished. Just waiting on the voice actress but she was recently elected into a town position so she has been very busy.
