Yes and no. Was it taken improperly? Yes. Is anything, I mean, ANYTHING, going to happen to the people running the private servers if NCsoft does not take action? No. Current laws on Intellectual Properties don't allow independent prosecution, which is the case for a robbery of actual physical goods. The police can still chase you down and press charges if you rob a store, even if the store owner declines to do so.
The silence on this issue is deafening. The private servers have been running in the public's knowledge since April, which is 4 months. Why hasn't NCsoft said a single word? If they said anything at all, most of the servers would close shop. They don't want a company with NCsoft's resources prosecuting them.
Is the issue that they no longer own the IP? I have seen the claim that because NCsoft did nothing with the IP for so long, they no longer own it. I think this is wishful thinking, but it has been brought up a lot.

I don't think you can lose IP, once you own it, you own it. Trademarks on the other hand you can lose, like Gibson did with the Flying V in Europe.
