#2: Internet penetration is at the same level and Western Europe even exceeds US
So what is this all about?

Well, if the company sends out beta CDs then it costs more to ship it overseas...however since most companies seem to do downloads, I have no idea what the problem is.
Saga of Ryzom is european as is Dark & Light I believe, so maybe you will get to play those before us in the western hemisphere.

SECOND: I think the biggest reason companies do this is the NDA. They have no legal weight outside of US laws. If someone takes the software and account and posts it on Kazza there is nothing the software company can do...and this scares them

Well, it is important to think that the point of beta testing is not for the worlds entertainment. The purpose of these tests is to work the bugs out of the game and test server loads, etc. To run a multi-national beta test (at least having servers across the globe) would only add to their headaches and serve no real gain...other than making non-US fans more happy.
I think it makes sense for a game developer to keep the servers local, where they can easily monitor and admister them. It would not supprise me to see games developed in Korea or Europe not allowing US customers to beta...it is just logical.
Some of these companies (like Mutable Realms) are allowing anyone to beta, but they are still not setting up servers in other countries...they just make to connect from afar.

Uhm I have been signed up for that beta even b4 they changed company, never did I see anywhere that they were excluding sign ups by US/Canada so I believe you are wrong.

actually beta 1 (under GOA) was exclusive to Europe it even said so on their site back then.

Also, if the developers get players who are in the same geographical location (US only for instance) then there is more of a chance that those players will be playing at similar times, so they can have the server loading they want. And they will have a better idea of when most of those players will be online so they can monitor the players more closely and be reay for support issues and whatnot.

FF XI is on japanese Servers.
I ping around 90 to 110 to US MMORPG servers wich is WAY more than needed to play smooth.

Well Saga of Ryzom is Europe only atm, so you guys end up on top there. Also I believe the reason is partially due to the laws and also about a publisher. Most games don't get European publishers until the game is near release (as they mainly just distribute the product) where as North American publishers prefer to invest in the game at the beginning and own the rights to it (IE EA and UBI).

Well If you think about it there is also Y's online which is also eu only so I have no idea how many games are eu only but there are a few so its not only the Us who does closed beta open to only its residents It is also in EU the same on some of its games

Actually, there are a lot of games, usually not the mainstream ones of course, that are only in europe and/or asia. Probably far more than those games for north america. Believe it or not.
There are a lot of reasons for it, sometimes the company doen't have the rights to whatever property that they are licensing outside of the U.S. and/or Canada, therefore they cannot let people outside of those areas play. Secondly, as someone else has said, the non-disclosure agreement has zero legal weight outside of the U.S. There are always legal reasons why these things are done, just as there are some games that are done specifically for the Asian market.
