If accepted into the beta, you're going to have to sign a Non Disclosure Agreement (NDA). Technicaly to sign any legal document you have to be at least 18 years of age or have your legal guardian (parent) sign for you. Not sure if Blizzard will allow for this though.
What I'm guessing will happen is you'll sign the NDA virtually (meaning on Blizzard's website), so you can lie and say that you're 18 even if you're not. As long as you don't break the NDA, you should be pretty safe. Though, even if you do break the NDA, the worst that will probably happen is you'll lose your beta account.

Some beta accounts now require a photo-copy of your driver's license along with an actual printed out EULA aggreement with your signature. So, thats good. If it's meant to be 18 and older then its 18 and older

You have to wonder, for a young kid, what would be worse:
1) being sued
2) losing your WoW beta account

If I a person won a Beta account...personally, Id rather just get sued.
but in reality you would get the shit end of the stick, because if you got sued...they'd most likely take the Beta Account aways also.
