I highly doubt that you will get arrested for playing on free RO servers. UO has had illegal servers running for years and I have yet to hear of anyone who got arrested. Same thing with Warcraft III and WoW. There were illegal servers running those games too. No one has been arrested yet.
They wouldnt arrest you, it'd be too much of a trouble to do so. Although, the people that run the shard, and if the shard is rather well known and large, they'll most likely threaten to take them to court if they dont shut it down.

Whether or not it is illegal is still up for debate.
On what grounds is it illegal? As long as you figured out the communications protocol yourself and you didn't decompile their server software or steal their server source code, then you have done nothing wrong by creating a server yourself. That is why there has not been anyone sued or arrested for it. It is perfectly legal as far as I know...
They may put legal pressures on someone, with threats of suing them or whatnot and it may work. Most individuals who are writing a server for a game probably could not aford to get a lawyer and go to court to fight such a case, even if they were going to win. Especially since creating your own server is not going to get you any money...

If you, as a player, BUY their client, and then run it and connect to my server, you re not breaking a law either. You paid for the software, and you are not breaking the law by using. nothing says you HAVE to connect to their server.

Someone who develops a server did not use ANY code written by the original developer. You do NOT have access to any of the server code at all.
