Does this only apply to trading and selling?
What happens if somoene wants to share or just give because that person isn't playing with it anymore?
I would think, giving an account would be allowed since the game would want active testers to reply and find bugs and such, no?

I think its all about the NDA, I mean that is a legally binding agreement to say you will not let anyone else have access to the game.......   It could be a bit tricky legally to rewrite it to 'you cannot let anyone else have access to the game but you can give it to a friend if you really trust them and make them promise to be good and not tell anyone.......'

The Sharing of beta accounts is illegal. Beta accounts can only be used by one person and that is the beta tester for that account. An NDA is a Non-Disclosure Agreement. It is a legally binding agreement which forbids the unauthorized distribution of beta material, including accounts, to anyone other than the beta tester who signed the agreement.

No "if's", "and's", or "but's".

Violators will be banned. Period.
