If one of the dev trackers was up to date, I think you'd see that there probably will be a FFA PvP server, however, there are things that they are trying to work out, like PvP in the PvE cities, and so on. So no answer on if you'd be flagged for PvP all the time, odds are...yes.
On the "PvE" server, you are flagged for PvP only in the Border Kingdoms. (that's leaving Arena's and Drunken Brawling out of the equation)
I believe that Athelan in the past 30-45 days indicated that a FFA PvP server would be likely, of course no dev tracker, and I cant find the link...it could have been Jayde as well... Sorry, wish I had the link, as I hate saying something unless I can point to the dev quote.
They do have things to iron out though, how combat would work in the PvE cities and so on. So it's not a 100% thing the way I understood it, rather that assuming they can iron some things out, it'll happen. Also, no idea how high on the priority list those kinds of things stand.

FFA Pvp servers are always a financial decision, can the devs throw away a server to the few that will partake?
Because historically, these type of servers always have very low populations.

Why would you assume that there would be a loss of items and money?
FFA isnt free loot, and free loot isnt even a consideration.
A.) As the above poster mentioned, there is no item loss on even FFA servers
B.) Ganking, particularly excessive ganking, earns the ganker a bounty, and NPC goons hoping to collect.
C.) Most people don't join an FFA server because they are afraid of getting killed, exceptions made for a few deluded morons of course.

FFA servers are by the far the most fun and most hated in every game I have played. I noticed that alot of people can not handle to constant threat of Player vs Player it is a reality and a understood one. I recently left my guild of 5 because they could not handle Vanguard FFA PVP!!!! VANGUARD!!!!!! Imagine if they actually release Darkfall Online there is no way I can run with a guild that can not hack Vanguard FFA...
In my personal opinion and only my opinion ffa servers are the most fun because of the community it attracts (sure there are some bad seeds but they are in every game every server atleast on ffapvp you can slaughter them) and the constant threat of attack from anyone anywhere anytime.. I believe it adds a new element of gameplay that is otherwise not gained through PVE. Imagine for 1 minuite you are walking down the street to the tavern and you see that guy spamming crap about Chuck Norris, or your Mom i can think of tons of examples. You walk directly up to him unsheathing your sword/axe/dagger/bow on the way to him as he turns to face you you proceed to hack him to shreds.
There are many examples I and others I know can think of where you just want to attack that guy for whatever reason ally or not, FFA allows this
! loot ninjas !... I believe everyone at one time should dip into the realm of ffa if not just for an hour or so to view the beauty of chaos.
