    I know you say "Can't be owned by SOE", but you should really consider EQ2 PVP servers.  For me, it has all your other requirements.  I recently tried EQ2 after burning out on WoW, and I am loving it.  I also am playing on the PVP servers. 



    Past: EQ, EQ2, DAoC, SWG, WoW, LotR, VG, WAR, GW, GW2, Rift
    Present: The Elder Scrolls Online
    Future: Everquest Next

    Dark Age of Camelot could be a game you might like it has great PVP and ok PVE there is a grind after the cap you have your Champ Levels and Realm Rank, on the classic servers and on the normal servers you have your Master Levels to get where before you need about 4 plus full groups to get but now Mythic made the game more easy where stuff can be done with 1 full group.

    Guild Wars i can say.  One of the main aspects of the game is PvP, great graphics too, well for me anyway.  Not cartoony in the least.

    Another one is Sword of the new world.  Im not sure about PvP but you can be sure about solid PvE.  and the fighting is fast pased so it wont get boring easily.  It will be in beta next week so i would say go ahead and try it out.  Oh and its gonna be real cheep compared to most MMO's these days.  20 bucks retail, 9 dollar monthly fee.

    Oh and a new one is LOTRO, i know nothing about this game just that its a wow clone, but dont be frightened, no cartoony graphics, just the gameplay and mechanics are like WoW. But ask someone else about LOTRO, someone who knows something
