If you actually took the time to find some DX10 screen shots of AoC and compare them to the DX9 screen shots, the game does look different. There is more depth when it comes to lighting and shadows.
As for everything else, I didn't upgrade for anything, I already had XP and Vista installed on different partitions. I'm just pointing out why people feel cheated. Most players don't know anything about computers so when they saw the better looking DX10 screen shots and read the developer comments about how great the game looked, guess what? They upgraded because, buying into the hype, they wanted to experience the game in all it's graphical glory.
Oh and the only people who rushed the developers were developers themselves. Maybe investors too. Funcom had a perfect launch window. Right after people started to get bored with GTAIV and way before WAR and WoTLK to assure no competition.

Yes it has to be a legal document, stating the name of both parts and signed by the contractor. As you say, clicking OK doesn't have much legal strength (but it might have some, depending on the judge).

Take it for a test drive first, why cant people wait? mentality on thinking they will loose out I guess if they dont start from day 1 in an mmorpg.
It really doesn't matter if the guy wins or loses the lawsuit.. If he files it, the press will be all over it and it will drag Funcom's name into the toilet. The is the true power of a lawsuit.... like it or not.
When you buy a game you don't like, you theoretically lose the value of this purchase. I say theoretically, since the personal knowledge that something is not to your liking is sometimes more important than the actual cost of the game (or movie, song, food, etc.)
When you buy a computer to play that game however, you don't lose the computer. It is still there and unlike consoles you can put it in other uses. You may end up playing another game, but the computer does not lose its value because the game was not to your liking.
You're right; we're just lazy I guess. However, legal action may not be the best course. For instance, I still say that everyone here would agree that boycotting Funcom is 1) easy to do, 2) free, 3) hurts Funcom's wallet, and 4) something everyone can do without knowing law. To those people who say "Man stop taking it so seriously, just get a refund and shut up"...it means you're accepting that the company did that to you. Admittedly, a simple MMO video game may not be enough incentive to cause any kind of action other than returning that game and forgetting about it. That's fine, but if we can send a message to other companies that we won't take this kind of crap, it could make future MMOs better. Or it could not; the developers have to be smart enough to understand that fact...
I agree with that, if everyone is so upset, cancel you sub, break the disk. Post bad reviews of all the FC games everywhere you can make posts about how bad all of Fc games are, hack any webstie related to FC, make free aoc bots and spam the official forums with link to download them.
If you still play done only one thing: gank make the noobs cry, gank till you get banned. Try to scam as many players as you can, try to make every ingame player event fail.
Do everything you think mthat might make FC's sub numbers go down. If you work at a store where they sell games, hide the AOC cds, if you work at the tech department of a company make conan and funcom banned words that people can't even look for in google. If you work for the electricity company or water company that provide Fc with these services cut them off.

If a company only tells you that it's 3m high you have no case, if it's documented you might have a case.
Overall atleast where I life it takes allot of time and documents to even consider rebuilding your garaga, so many laws before you even are aloud even when owning your own house to take in considerations, so overall atleast not where I life would someone be so foolish to start rebuilding something for something he isn't even sure what size it will be.
Even so I still am 100% sure DX10 will NOT make such a great impact as some seem to think, I made this topic more then a year ago and still stand with what I said back then DX10 just looks like a game on high or very high settings (DX9) and the DX9 version I see looks like a game put on with low or very low settings. And till today I have not seen a DX10 game that truly made the game look more alive then when you are able to play a game on high/ultra/extreme high settings with DX9 settings. And like I said back afcourse people who might have had low system specs and now suddenly might have DX10 systems will notice a big difference, but the majority of gamers who often upgrade their systems will NOT see that much difference then simply games on high with DX9. Nope, all they would need to show was that it looked nice using 'DX10 & Multi Core' regardless of whether that was due to their own efforts or just something inherent to the higher specifications. As it doesn't mention 'DX9 or Dual Core' at all, they wouldn't even need to demonstrate that it performed better using 'DX10 & Multi Core' as that is only presumed by the reader.
Technically they even could argue that 'Multi Core' includes 'Dual Core' since 'multiple' only means greater than one. Would advertising men grasp at that straw? Of course if it really went down to a legal battle.

AoC actually runs on my system, which according to my dxdiag is DX10! so the bix tells me that the game is enhanced to use dx10...otherwise it wouldnt work with dx10 if it wasnt enhanced to use it would it?
Hmm but dont certain games only work with certain DX versions? i am sure i have had to download rogue dx patches just to run certain games before. Like Everquest when DX9 first came out

Enhanced can mean a lot of things; including that the game will run if you have a DX10 compatible card. If DX10 is backwards compatible, wich I believe it is, then it means that they enhanced the game to take advantage of DX10 ability to run without it. An optimistic way of looking at it.
Edit: Just to point out. Everyone that complained it was taking to long to release, or complained when they postponed the release. Hope your happy. You got what you asked for. How about when everyone stops rushing the developers to release a game when you want it, then you people can start complaining about bugs, and missing features. All I ever see is a bunch of whiny brats who put down developers for taking to long to release and then put them down again when they release before the features are all in. What do you people want? The game now, or the game when it's done. You can't have both. Stop complaining about one when it's effecting the other.
Darkfall is vaporware but rest assured that when it's released if it has a single bug those same people will start yelling that the game was release to early. Funny how that works.
If you actually took the time to find some DX10 screen shots of AoC and compare them to the DX9 screen shots, the game does look different. There is more depth when it comes to lighting and shadows.
As for everything else, I didn't upgrade for anything, I already had XP and Vista installed on different partitions. I'm just pointing out why people feel cheated. Most players don't know anything about computers so when they saw the better looking DX10 screen shots and read the developer comments about how great the game looked, guess what? They upgraded because, buying into the hype, they wanted to experience the game in all it's graphical glory.
Oh and the only people who rushed the developers were developers themselves. Maybe investors too. Funcom had a perfect launch window. Right after people started to get bored with GTAIV and way before WAR and WoTLK to assure no competition.
Correct me if I am wrong but as far as I know UELAs as we see them in games like AoC are not even legaly binding in the EU.
In order for an UELA to be legaly binding here it has to be signed on paper with witness signing too. Clicking on an "agree" key is not legaly binding.

Yes it has to be a legal document, stating the name of both parts and signed by the contractor. As you say, clicking OK doesn't have much legal strength (but it might have some, depending on the judge).

Then the van arrives and it's 2m high. Probably a judge will see that you have the right to a refund and to the expenses of building a new door that you wouldn't have done if it was not for the new van.

It really doesn't matter if the guy wins or loses the lawsuit.. If he files it, the press will be all over it and it will drag Funcom's name into the toilet. The is the true power of a lawsuit.... like it or not.
When you buy a game you don't like, you theoretically lose the value of this purchase. I say theoretically, since the personal knowledge that something is not to your liking is sometimes more important than the actual cost of the game (or movie, song, food, etc.)
When you buy a computer to play that game however, you don't lose the computer. It is still there and unlike consoles you can put it in other uses. You may end up playing another game, but the computer does not lose its value because the game was not to your liking.
I agree with that, if everyone is so upset, cancel you sub, break the disk. Post bad reviews of all the FC games everywhere you can make posts about how bad all of Fc games are, hack any webstie related to FC, make free aoc bots and spam the official forums with link to download them.
If you still play done only one thing: gank make the noobs cry, gank till you get banned. Try to scam as many players as you can, try to make every ingame player event fail.
Do everything you think mthat might make FC's sub numbers go down. If you work at a store where they sell games, hide the AOC cds, if you work at the tech department of a company make conan and funcom banned words that people can't even look for in google. If you work for the electricity company or water company that provide Fc with these services cut them off.

Overall atleast where I life it takes allot of time and documents to even consider rebuilding your garaga, so many laws before you even are aloud even when owning your own house to take in considerations, so overall atleast not where I life would someone be so foolish to start rebuilding something for something he isn't even sure what size it will be.
Even so I still am 100% sure DX10 will NOT make such a great impact as some seem to think, I made this topic more then a year ago and still stand with what I said back then DX10 just looks like a game on high or very high settings (DX9) and the DX9 version I see looks like a game put on with low or very low settings. And till today I have not seen a DX10 game that truly made the game look more alive then when you are able to play a game on high/ultra/extreme high settings with DX9 settings. And like I said back afcourse people who might have had low system specs and now suddenly might have DX10 systems will notice a big difference, but the majority of gamers who often upgrade their systems will NOT see that much difference then simply games on high with DX9. I do beleive it might effect performance more then it will visiually. DX-10 rippoff ?? < my old topic.

In the 1970s I can remember my mum buying a bottle of shampoo with the new trendy name of 'Organics' & which had a cap shaped like a 'Honeycomb'. The advertising copy on the bottle went on & on about the virtues of natural products but you only discovered the truth if you read the small print at the bottom of the label on the back which said something like -
"This product is called 'Organic' because it contains the Tetrahedral Carbon structure as found in nature"
The label didn't point out that by that logic you could wash your hair in petrol and get the same benefits, but that's what advertising people do. Everything is twisted so that they can appear to say one thing but still have a legal fallback to justify something entirely different in case of complaint.
The use of the term 'Enhanced' is equally slippery & it would be very difficult to prove that Funcom's comments on the box about being 'Enhanced for DX10 & Multicore' were fraudulent when it is actually a pretty bland & nebulous thing to say.

Nope, all they would need to show was that it looked nice using 'DX10 & Multi Core' regardless of whether that was due to their own efforts or just something inherent to the higher specifications. As it doesn't mention 'DX9 or Dual Core' at all, they wouldn't even need to demonstrate that it performed better using 'DX10 & Multi Core' as that is only presumed by the reader.
Technically they even could argue that 'Multi Core' includes 'Dual Core' since 'multiple' only means greater than one. Would advertising men grasp at that straw? Of course if it really went down to a legal battle.

Nope. For it to be enhanced for DX10 it would have to to look or perform better on a system using DX10. It doesn't. QED it is not enhanced for DX10. It doesn't support any DX10 features. It is not Enhanced for DX10.
If it didn't support any DX10 features then it wouldn't run at all, what you mean is it doesn't support any 'DX10 Only' features which is a different matter entirely.

AoC actually runs on my system, which according to my dxdiag is DX10! so the bix tells me that the game is enhanced to use dx10...otherwise it wouldnt work with dx10 if it wasnt enhanced to use it would it?

Hmm but dont certain games only work with certain DX versions? i am sure i have had to download rogue dx patches just to run certain games before. Like Everquest when DX9 first came out

The game is not enhanced for DX10. Period. It does not even support DX10. It would need to support DX10 before it could give an enhanced experience in DX10 wouldn't it? If you are confused please see the definition for 'enhanced'. I posted a few posts ago.
