    Did you read what I posted or not?  I thought I explained it pretty clearly.  Companies don't just waive their trademark rights because they think it is the right thing to do.  They waive their trademark rights when money changes hands, generally.

    The "FACT" is that Dark Fall: the journal is the reason why they cannot get their name trademarked here.

    Everything I said is a fact is available on the USPTO website for anyone to go verify, I'm just not going to comb through it again because it takes a while if you are not an expert.

    Nothing you said is a fact, They did not buy any trademark rights from anyone.

    The fact is that they only have 1 live application still in the system which is suspended and has been in troubles and suspended since 2003.

    And that is the one that gives them legal rights to use "Darkfall" as a computer game commercially within the USA.

    Technically you don't need a trademark. But the fact that someone already has a copyright on this name it would be a completely idiotic thing to release the game with that name. They could get sued instantly even if the current owners allow them to use it. They could at anytime change their minds..

    The fact is -- the trademark atorneys job is to make sure 100% without a shadow of a doubt that there could never be any legal problems from a trademark they allow through. If there's even a tiny risk they will never allow it through.

    "Darkfall" is just completely tainted with potential problems and that's why it still is not through since 2003.

    You realize those offices are in greece, right? As in EU, not the U.S. You cannot use the same name as someone else in the U.S. just because you have the name in Europe.

    It was already pointed out earlier in the thread that they didn't abandon it, they just didn't give sufficient response when requested. It's already been taken care of.
