you need to get hurt on the job. and than sue. claim you were overly tired from forced OT. get that fucker on recording threatening you, if you do not comply to his OT demands. i hear backs and heads are good injuries.
I have to say that it's appalling so many posting here are unsympathetic to your situation. Comments like "that's life"....well, not helpful in the least. Most people are reluctant to just walk away from a job because they are responsible! They have bills to pay and a family to take care of and just walking away is not practical. Furthermore, depending on the job market in your city and/or your profession, a new job may not be sitting there waiting for you. Those unsympathetic to your situation must have no family to support or no problem finding a new job, or they would understand.
I have worked in Human Resources in the past and know my State's Labor Laws, as well as, the Federal Government's Labor Laws. Unfortunately, it is completely lawful for a company to ask you to work whatever days/hours they want and they have the right to fire you if you decline. Simply your 'refusal' to work is all they need.
However, by Law, you must be paid overtime at no less than 1 1/2 times your normal hourly rate, for all hours worked over 40 in one week. There are NO laws that require they pay you more for holidays, nights, weekends, etc.
I'd say, at this point, if you have the ability to search for a new job, start looking immediately. The company you are working for cares nothing for the welfare of it's employees. Yes, that describes MOST companies, but good ones are out there. You just have to look harder for them.
And I must admit, Bluberryhaze, has a GREAT idea! If you don't mind getting injured, and using the excuse of being exhausted from excess work hours, it might open their eyes to the problem, and get you a bit o'coin in the process.
And I counsel all my friends with problems at work to WRITE DOWN all bad conversations you have with management. If you can record conversations, do it! Most cell phones have a 'record' feature, so see if yours will record. This is called, "Covering Your Ass". One day, you may have to relay things said between you and devil-boss to a jury, and having a transcript of it will be very helpful. Your attorney will be very very very happy with you.
Originally posted by bluberryhaze xdarc, you live in michigan? i thought that was a democratic stronghold? im surprised at what i read: http://blog.laborlawtalk.com/2006/11/24/michigan-mandatory-overtime-laws/ "Under the Michigan mandatory overtime laws, an employer may legally require an employee to work overtime. The employer may require an employee to work 20 or more hours in a single day, or 70 or more hours in a week. An employer may legally require employees to work on Saturdays, Sundays and holidays, even if the employee is normally off on those days. In addition, if an employee refuses, the employer may legally discipline or even fire them. However, the employer does have to pay overtime in most cases." And in all honesty. i do agree with mandatory overtime being unfair. that paragraph above is, in my conservative republican opinion, GROSS. 20 or more hours in a single day? 70 in a single week? fuck that state and/or fuck that job.
Michigan is a Democratic stronghold in metro Detroit and Flint. Outstate (outside those areas) it is a Republican stronghold. That is why Michigan is considered a swing state by both the Obama and McCain camps. Neither party should ever take Michigan for granted. Michigan very often votes a split ticket, with a single ballot reflecting votes for both Democrats and Republicans. It is all issue driven. This years issue is jobs/economy. That is why Mitt Romney was a good choice as McCain's running mate. I have yet to talk to a single Michigan Republican that is happy with Palin as a choice, they all wanted Romney (mainly as the Presidential nominee though).
I stated once, in another thread, how a Republican Governor named Engler once got black support in Detroit when he advocated charter schools. Detroiters wanted the option to take their kids out of the failing Detroit Public Schools and put them in charter schools, and that alliance got them what they wanted. The opponent in this battle was the Michigan Education Association (MEA), a Democratic support organization.
It is not impossible for a white Republican Governor to get the support of the black community if they listen to the concerns of the black community and act on them. However, if they generalize and ignore those concerns, those voters will not support them. Surprise, surprise.

I had a big problem at my former job. the union showed us no(zero) representation when Time Warner had us technicians begin to learn the telephone business. Im a very opinionated person on these forums and that does not change in real life.
I tried to rally the techs, get it under their skin that what was being done was grossly unfair. new job skills, new testing equiptment, new knowledge warrants an increase in pay. I was vocal about this to my foreman and my general foreman- he brushed it aside. saying this is the business we are in, there is competition with verizon fios, and the company needs to remain competitive.
whatever.
I refused to do any phone work. they had let me get away with this for a long time because i was a thorough cable and internet tech with the lowest repeat trouble call percentage, year after year. no customer complaints, just praises.
so in november, when my manager handed me my new phone tools i had made my decision. i took the tools and a sheet of paper and pen. i wrote my notice of resignation.
me leaving that job was an eventuality anyways, i want to move my family out of new york.
