Random Scrolls

Is it just me or are random scrolls used in pvp whenever I fight another player? Often, I see scrolls like dark hex and silence being used by my mercenaries, despite the fact that I never used them. If this is true, then I think that it isn't a good idea since it adds a "luck" factor to pvp, which is already under the RNG in damage and action power. If by chance, you get a bad scroll, and your opponent gets a good one, then it can seriously hurt your chances of winning. Even if they retain it, I'd like to see it tweaked in some way.
