An N.D.A. is called a NonDisclosure Agreement. Basically if you beta their program you have to "sign" or agree to a series or one contract stating that you will not disclose the nature and/or details of gameplay. This could range in from skill information, professional tree progression, bugs, and or exploits. Basically, if its in the game and not made know on their official web page and without prior permission from the company you have to keep your mouth closed.
Many betas require you to be 18 years of age simply because of this fact alone. Legally, it is hard to pursue anyone who is a minor, however, if you disclose important information to the public, the Company who owns the development rights to that game has the right to make you be quiet, forced to delete your comments, or legal action can pursue.
The N.D.A is to protect that interest of the game. Competitive companies can get insider information and can do many things with it to their advantage. Usually the NDA is lifted about one month prior to release.
For the most part, Beta N.D.A are very common. Only recently a couple games has not required a NDA before betaing their game.
In my opinion, I believe a NDA is a must. It h as nothing to do with ripping off the consumer to hide the fact that it is riddled with bugs. NDAs are lifted with plenty of time for you to go to their official forums and see how the beta testers felt. The company doesnt have a NDA to hide things.
Also, companies have pursued legal action in the past for NDA violators. One person from SWG beta scanned his beta discs and posted ingame screenshots 4 months before Beta3 was even set up. He was in Beta 2. SOE tried legal action but found out he was only 15, thus they couldn't do anything against him (noticed, this kid even broke the age disclaimer).
NDAs are there for a reason. You dont want other companies knowing your secrets.
