The mistake was MDY did not Open Source Glider, no company should have the right to dictate or limit what an individual can do with their products API. Shame on Blizzard for making an API and providing all the tools for someone with half a brain to make use of it.
In reality there is NO WAY to stop botters, only GREEDY botters that dont Open Source and instead want to try and make money get caught!

Maybe developers should design games where botting and gold selling is not needed?
Besides, most games need botters and farmers to survive. Blizzard is probably the only one that could really afford banning lots of accounts.
Also, I think they shouldn't have won that suit.
