I do not see how the makers of MO can say they have an NDA when people have purchased a product. I feel once a purchase has transpired and and money exchanges owners for a goods or service then that goods or service is open game to being reviewed or discussed. Considering how much people payed to get into the "beta", basically purchasing the game, how can they even think of keeping it under and NDA?
Ok so apparently in one of my posts, the moderators of these forums felt I had broke the NDA for the game and banned me temporarily for that post. Just to give you a hint on what the post was, it was when I mentioned something about a pic of MO, didn't post a pic, didnt post a link to a pic I just mentioned of a pic in the future. So fair warning to all who feel like posting anything refeering to beta be careful what you post because they seem trigger happy.

Ok I worded it wrong, what I meant from that post was if you carry on information that was presented to you from someone who broke the NDA it is still information obtained against the NDA meaning reposting it can still get you into trouble regardless.

But since I am somewhat of a professional artist I know that if you use pieces of existing material artistically and editted in such a thorough way that the result becomes something completely different, it will be regarded 'a piece of art' in court, (at least in a Dutch one). Similar to a collumnist quoting parts of a book. It is rather complex and there is a fair bit of interpretation involved and I'm not sure if my sig would pass the test though it consists of 7 images put together. Plenty of artists use 'ready found' material like that and use it as parts in their own work, though.
That doesn't mean mmorpg has to respect that; they could rather want to be safe and sure and get rid of all our sigs and avatars, like you say.

Technically telling people you are in the Beta is a violation of the NDA. Its best if you are in a beta to just not say anything and if you want to say something you should log on the game forums and contact them ahead of time and ask them if you post would violate your NDA

Yeah, but that'd be boring ... I kinda love mmorpg.com's colorful nature (and we HAVE to visually neutralize the banners!). Though people who hate the additional loudness on each page of course have the option not to display any sigs in their profiles.

Are you allowed to say what is said in the NDA or link to it? Because I am in beta, but block B so havent played it yet, but I dont recall seeing an NDA to sign yet.

Nah, you might be right. But since I am somewhat of a professional artist I know that if you use pieces of existing material artistically and editted in such a thorough way that the result becomes something completely different, it will be regarded 'a piece of art' in court, (at least in a Dutch one). Similar to a collumnist quoting parts of a book. It is rather complex and there is a fair bit of interpretation involved and I'm not sure if my sig would pass the test though it consists of 7 images put together. Plenty of artists use 'ready found' material like that and use it as parts in their own work, though.
That doesn't mean mmorpg has to respect that; they could rather want to be safe and sure and get rid of all our sigs and avatars, like you say.

Pretty much, anything that has to do with what is happening in beta is against the NDA so even people talking about hearsay stating there are no mobs is breaking the NDA.
You cannot break a contract if you do not sign the contract... A NDA is like a contract, once signed you have to follow it... If you do not sign it, you cannot break it.... its very simple logic
True. Though a site like mmorpg.com can have a rule in place not to tolerate any info originating from any NDA break. If you post pics you found on the net or use them in your sig, even if you are quoting something someone said which someone else who broke the NDA said, you might not be breaking the NDA legally (you never signed anything and 'it was there already'), but you can still make an infraction to specific board rules.
Agreed, but I doubt all the avatar pics here are "legal" -- say yours, for instance. Where did you get that horse? Did you draw it yourself? If not, did you get the artist's permission to use it?
My guess is that 100% of the avatar pics here, unless a photo of the actual person, are "illegal" and in violation of mmorpg.com rules.

Or they could do what a lot of other forums do: Provide a stock set of images to choose from and disallow the uploading of avatar pics.
Technically telling people you are in the Beta is a violation of the NDA. Its best if you are in a beta to just not say anything and if you want to say something you should log on the game forums and contact them ahead of time and ask them if you post would violate your NDA

I am assuming this has to do with me, and id agree with this story the person should be held accountable for posting a SS from beta thing is, if this hypothetical story is based off of me, I didn't post such a SS I said id post a SS after the NDA was lifted.

Yeah, but that'd be boring ... I kinda love mmorpg.com's colorful nature (and we HAVE to visually neutralize the banners!). Though people who hate the additional loudness on each page of course have the option not to display any sigs in their profiles.

Doesn't matter. Most NDAs prohibit you from even mentioning you are IN the beta. You won't get any sympathy from me. You should, however, learn to read AND comprehend the entire NDA before agreeing to it.
Are you allowed to say what is said in the NDA or link to it? Because I am in beta, but block B so havent played it yet, but I dont recall seeing an NDA to sign yet.
As for comprehending the entire NDA. Good luck with that. Usually they are full of legal mumbo jumbo that people, with no law degree, cannot fully understand. Altough the basics is quite clear:
