Well, beyond a few people's posts about what is and isn't illegal, most of you don't have your facts straight.
1. If your source code contains any/all material from an mmo, like wow, swg, runescape what have you, its illegal. The only time it isn't illegal if you use that source code to reverse engineer your own game that doesn't have a single line of code from the regular game, in short you make your own game private servers are illegal without the express permission of the company.
2. All forms of modding regardless if its homebrew on your ds, because you want to make it your new fancy kindle, or you're stealing games on your xbox its all illegal under the Digital Millenium copyright act. To actually mod a game you MUST circumvent copyright protection with under the DMCA: is illegal. Ice cracked down on more then 18,000 modders and arrested them, putting them in jail in 2008.
3. Xbox owns the service and can decide what and who they give service to. You agreed to the EULA for xbox live, and if you don't abide by it they have no liability for anything they do, that's the law and guess what its not on your side.
For all other questions about what is and isn't illegal about modding refer back to point 2 of the DMCA, just to make sure that you understand that EVERYTHING is illegal. The idea is with the DMCA you don't own the consoles you're just renting them from the company. Don't blame me that's the law I'm afraid.

1. What i said is, you make your own server from scratch and players use the original client for playing without modifying it. For example you can make use of the Host file.

Even if you made the server from scratch, you'd still have to remake the entire game. Meaning all the music you'd have to do yourself, all the models you'd have to do yourself. Pretty much everything that it takes to make an mmo you would have to do yourself. Like I said the only time its legal is reverse engineering, which is pretty much looking at the source code to find out how an mmo works/how the server architecture is run and then make your own based off the principles of their theory, but not exactly the same. Anything else and its copyright infringement/piracy

The main thing that worries me is the way the gaming market, adn the gaming companies in particular seem hellbent on getting the whole thing to cave in on itself. Many companies (MMORPG market) in particular seem to have this real sheer hatred of innovation of any kind, there are very few fresh idea's and those that do sound fresh usually get mangled into a ball of crap and either fail becuase they are poorly done, or because they rework them towards mainstream.
Its not a dig at WoW by the way, WoW did have its own innovation, in that they decided, lets provide actual customer service, advertise the game, and get it polished and working as well as we can, and hell it worked. It was the first game I played that had dedicated UK customer support, the rest were in america and it was "tough luck" for me. The problem is everyone else thinks they can program WoW and hordes of screaming nerds will turn up and throw money at them all day long.
We used to buy games before that when you think about it had very very little replay value, so people started modding games, developers started supporting it and all of a sudden people bought the games because of the mods. I bought torchlight recently because I could mod the game and it intrested me, the mods themselves are awesome as well. Heroes of Newerth was developed as a standalone game based on a modifcaion for Warcraft 3 (DOTA). Nowadays companies like Activision/Infiinity ward remove the possibilities for dedicated servers and user mods, and for what reason? They were there before and now they're not. I'll admit the current system works well, but they provided us with this for every game beforehand, why change it now? Ironically, the PC market are so angry that the game is the biggest target for hackers/pirates/etc. Steam does a piss poor job of banning, and the game has already been cracked so people can play through official channels without buying the game.
As well as this, games are getting more and more expensive, everything goes up in price over time, fair enough, but games are hopping way ahead of the competition, and when you really want to charge an extra fortune, you can bundle a plastic "accessory" along with it and milk money that way too! Activision (again LOL) put COD6 out with a RRP of £54.99 in the UK. The most expensive I have ever seen for a regular game, and some tool in their company said they would like to charge even more! The game is great ill admit, but £10 on top of a regular game for a small step forward, and for less features? Get real, and to be fair, there is a severe lack of innovation in the game again, few extra features like your own custom killstreaks etc, but it plays more or less like COD4.
Darkfall/Adventurine also seem to live in the dark ages a bit, they are charing a very high price for a game which was hated by a lot of people (Although it wasn't justified cos they did eventually release). The game, the company and the service were all unproved, but they charged like it was AAA title, and with game sales being controlled, low volumes meant high demand, so people who were not 100% sure would have bought anyway cos they didn't know when there next chance would be, people tend to be more willing to part with cash when they think they might miss out on an opportunity to get ahead. A free trial fo the game that was anywhere near passable would get my money, most games now have one eventually, and for an MMORPG its getting to the stage where you do need to have one, you are not asking people to buy an overpriced game (ala COD6) but you ar also asking (and hoping) they make a long term investment via subscriptions.
The fact is game companies seemed to come in first place in terms of arrogance and ignorance in this recession, they seemed to ignore it entirely cos I saw no prices drops for games, nor anything else to attract the consumer. Actual consoles however went down, but that appeared to be more because of competition than anything else. The arrogance comes from the fact that they couldn't ignore it entirerly, but somehow thought they were exempt from dropping prices to help consumers.The banks come a close second on account of the fact they were terrified during the worst of it, and are back to attempting to destroy it again now.
Finally, spare a thought for the poor fucking developers of all these games, for some reason they are everyone's favourite target now. The overpricing and exploitation of gamers is not their fault, they just make the game happen. My mechanic said to me a few weeks back that he would fix my car as cheaply as possible, because its not his business, and he gets paid the same wage wether the company makes £100 or £100,000. Its the same for developers, they don't set the price for the game, they just make it to standards set by someone else. Then someone looks at it and and conjures up a price compared to market figures and competitors. The fact that competitors games are well made and thought out, and their game is burned on a CD-R with the game name written in marker pen by Billy aged 7 is of no concern to them, they can blame that on developers, or processing. Developers DO work hard at your game, they do put loads of thought into it and dear god above all they want you to enjoy it. However when you buy the game and thing "the developers deserve this extra £10 on top for a top class game" its a nice thought, and you are right that they do, but they don't get it. Some fat guy in a suit who spends all day twirling his moustache and sneering gets that extra money, and you can bet your ass he doesn't give two fucks if you thought the game was worth it or not cos he has the money anyway.

If i made the server from scratch i wouldn't have to redo ANY content since its client-sided. The server doesn't send content to the client, that's why clients are big and servers are relatively small.
I can tell for sure that many of those banned aren't from the US.

I'm not exactly brushed up on Foreign laws so maybe I'm wrong on how a private server works in your country. I don't claim any knowledge at all in the laws or affairs of a different country so I'll give you that.
However from A US perspective doesn't matter if its server side, when the client connects the client is running stolen merchandise to connect to your server. Since you're not connecting to the official the person connecting is a criminal since that's illegal. The person running the server has violated the DMCA for the circumvention of anti pirating software, and is an accessory to the theft for allowing people to connect, where they can play with stolen content.
So maybe the laws are different there, but the DMCA here is a Blanket law that pretty much covers every single instance you can think up for making an mmo/modding and renders it illegal. Hell even reverse engineering has certain limitations here.
If its different over there, then yes you are 100% right and can do it, but if the server was hosted in the US then its illegal regardless.

other countries have there own laws for piracy if any. ex. Russia releasing DVD movies months ahead to slow piracy down in there country. Canada has a tax in blank media that goes to the US media for copy writing

If i paid for Live then i wouldnt just mod my 360 for it doesnt make sense. If i played a MMO and i hacked i would be not able to use the game anymore unless i buy a new one.

Well, beyond a few people's posts about what is and isn't illegal, most of you don't have your facts straight.
1. If your source code contains any/all material from an mmo, like wow, swg, runescape what have you, its illegal. The only time it isn't illegal if you use that source code to reverse engineer your own game that doesn't have a single line of code from the regular game, in short you make your own game private servers are illegal without the express permission of the company.
2. All forms of modding regardless if its homebrew on your ds, because you want to make it your new fancy kindle, or you're stealing games on your xbox its all illegal under the Digital Millenium copyright act. To actually mod a game you MUST circumvent copyright protection with under the DMCA: is illegal. Ice cracked down on more then 18,000 modders and arrested them, putting them in jail in 2008.
3. Xbox owns the service and can decide what and who they give service to. You agreed to the EULA for xbox live, and if you don't abide by it they have no liability for anything they do, that's the law and guess what its not on your side.
For all other questions about what is and isn't illegal about modding refer back to point 2 of the DMCA, just to make sure that you understand that EVERYTHING is illegal. The idea is with the DMCA you don't own the consoles you're just renting them from the company. Don't blame me that's the law I'm afraid.

Even if you made the server from scratch, you'd still have to remake the entire game. Meaning all the music you'd have to do yourself, all the models you'd have to do yourself. Pretty much everything that it takes to make an mmo you would have to do yourself. Like I said the only time its legal is reverse engineering, which is pretty much looking at the source code to find out how an mmo works/how the server architecture is run and then make your own based off the principles of their theory, but not exactly the same. Anything else and its copyright infringement/piracy

The main thing that worries me is the way the gaming market, adn the gaming companies in particular seem hellbent on getting the whole thing to cave in on itself. Many companies (MMORPG market) in particular seem to have this real sheer hatred of innovation of any kind, there are very few fresh idea's and those that do sound fresh usually get mangled into a ball of crap and either fail becuase they are poorly done, or because they rework them towards mainstream.
Its not a dig at WoW by the way, WoW did have its own innovation, in that they decided, lets provide actual customer service, advertise the game, and get it polished and working as well as we can, and hell it worked. It was the first game I played that had dedicated UK customer support, the rest were in america and it was "tough luck" for me. The problem is everyone else thinks they can program WoW and hordes of screaming nerds will turn up and throw money at them all day long.
We used to buy games before that when you think about it had very very little replay value, so people started modding games, developers started supporting it and all of a sudden people bought the games because of the mods. I bought torchlight recently because I could mod the game and it intrested me, the mods themselves are awesome as well. Heroes of Newerth was developed as a standalone game based on a modifcaion for Warcraft 3 (DOTA). Nowadays companies like Activision/Infiinity ward remove the possibilities for dedicated servers and user mods, and for what reason? They were there before and now they're not. I'll admit the current system works well, but they provided us with this for every game beforehand, why change it now? Ironically, the PC market are so angry that the game is the biggest target for hackers/pirates/etc. Steam does a piss poor job of banning, and the game has already been cracked so people can play through official channels without buying the game.
As well as this, games are getting more and more expensive, everything goes up in price over time, fair enough, but games are hopping way ahead of the competition, and when you really want to charge an extra fortune, you can bundle a plastic "accessory" along with it and milk money that way too! Activision (again LOL) put COD6 out with a RRP of £54.99 in the UK. The most expensive I have ever seen for a regular game, and some tool in their company said they would like to charge even more! The game is great ill admit, but £10 on top of a regular game for a small step forward, and for less features? Get real, and to be fair, there is a severe lack of innovation in the game again, few extra features like your own custom killstreaks etc, but it plays more or less like COD4.
Darkfall/Adventurine also seem to live in the dark ages a bit, they are charing a very high price for a game which was hated by a lot of people (Although it wasn't justified cos they did eventually release). The game, the company and the service were all unproved, but they charged like it was AAA title, and with game sales being controlled, low volumes meant high demand, so people who were not 100% sure would have bought anyway cos they didn't know when there next chance would be, people tend to be more willing to part with cash when they think they might miss out on an opportunity to get ahead. A free trial fo the game that was anywhere near passable would get my money, most games now have one eventually, and for an MMORPG its getting to the stage where you do need to have one, you are not asking people to buy an overpriced game (ala COD6) but you ar also asking (and hoping) they make a long term investment via subscriptions.
The fact is game companies seemed to come in first place in terms of arrogance and ignorance in this recession, they seemed to ignore it entirely cos I saw no prices drops for games, nor anything else to attract the consumer. Actual consoles however went down, but that appeared to be more because of competition than anything else. The arrogance comes from the fact that they couldn't ignore it entirerly, but somehow thought they were exempt from dropping prices to help consumers.The banks come a close second on account of the fact they were terrified during the worst of it, and are back to attempting to destroy it again now.
Finally, spare a thought for the poor fucking developers of all these games, for some reason they are everyone's favourite target now. The overpricing and exploitation of gamers is not their fault, they just make the game happen. My mechanic said to me a few weeks back that he would fix my car as cheaply as possible, because its not his business, and he gets paid the same wage wether the company makes £100 or £100,000. Its the same for developers, they don't set the price for the game, they just make it to standards set by someone else. Then someone looks at it and and conjures up a price compared to market figures and competitors. The fact that competitors games are well made and thought out, and their game is burned on a CD-R with the game name written in marker pen by Billy aged 7 is of no concern to them, they can blame that on developers, or processing. Developers DO work hard at your game, they do put loads of thought into it and dear god above all they want you to enjoy it. However when you buy the game and thing "the developers deserve this extra £10 on top for a top class game" its a nice thought, and you are right that they do, but they don't get it. Some fat guy in a suit who spends all day twirling his moustache and sneering gets that extra money, and you can bet your ass he doesn't give two fucks if you thought the game was worth it or not cos he has the money anyway.

I'm not exactly brushed up on Foreign laws so maybe I'm wrong on how a private server works in your country. I don't claim any knowledge at all in the laws or affairs of a different country so I'll give you that.
However from A US perspective doesn't matter if its server side, when the client connects the client is running stolen merchandise to connect to your server. Since you're not connecting to the official the person connecting is a criminal since that's illegal. The person running the server has violated the DMCA for the circumvention of anti pirating software, and is an accessory to the theft for allowing people to connect, where they can play with stolen content.
So maybe the laws are different there, but the DMCA here is a Blanket law that pretty much covers every single instance you can think up for making an mmo/modding and renders it illegal. Hell even reverse engineering has certain limitations here.

Tbh i have two xbox 360s, one for playing the games i cant get in my country and one for playing the real games online and such...

other countries have there own laws for piracy if any. ex. Russia releasing DVD movies months ahead to slow piracy down in there country. Canada has a tax in blank media that goes to the US media for copy writing

But to the topic of the thread. if you hack on any MMO even most private servers you are violating the rights to be on the servers and will be banned for it.
Why not modded Xbox for Microsoft X-live?
If i paid for Live then i wouldnt just mod my 360 for it doesnt make sense. If i played a MMO and i hacked i would be not able to use the game anymore unless i buy a new one.
Copy or not if you like the game buy the friggin thing. If not get rid of it cause you don't like it.

Tbh i have two xbox 360s, one for playing the games i cant get in my country and one for playing the real games online and such...
Why shouldnt it be allowed to modify something you bought? Microsoft doesnt own it, i do.
For example: you buy a car and changes engine in it, now your not allowed to drive on the motorway anymore... Does it sound correct?
they dont own it but they do own XBox Live.
