and wondering even more,so you know how betas should be,theres somekind of rulebook somewhere and laws how betas should be or you get your money back easily?
There are laws which cover consumer business transactions.. of which purchasing a computer game falls under. There are other threads on these forums that explain in great detail both the applicable EU laws and the relevent US regulations related to purchases made with a credit card. Feel free to look up those threads if you are truely looking for addition info!
basically Mortal Online Beta promised that you can have magical sword +5 ,and you couldnt get it so you want refund,or what rule?
If they advertise a +5 sword in the game and it isnt there then yes, that would be false advertising.
We are talking about a pre order for a game that was supposed to ship in September and many STILL HAVNT RECEIVED. Plus no communication.

Why do we keep seeing / hearing about these games being rushed out so unfinished, buggy or half-assed in some other way? If they all try so hard at cloning and wanting to cash in on blizzard's success how is it they don't learn from one of their most notorious creeds? I'm no fan of blizzard as of late but appearantly these "me too" wanna-be developers are. What? They have financial pressures from investors, release deadlines, etc? Well too bad because if you're too weak to adopt the ineffible "it's done when it's done" policy then do us all a favor and DON'T TRY TO EFFING MAKE AN MMO GAME YOU IDIOTS!!
A lot of people will not agree with or like what I'm about to say. However in this case things are a tad bit different than normal. I agree companies have got to stop releasing games that are half finished, I think everyone can agree with this point.
The problem in this case is when they put their product up for pre-order, they specifically stated (in different words) this game would release unfinished, with only the core functionality. They didn't even express a goal of it being polished, just being there.
They specifically stated pre-orders were needed, because they didn't have the funds or the backing of a publisher. They also stated they were having problems securing investors.
Taking all of this into consideration, who is at fault for being angry over pre-ordering this product? If you are told what to expect and you still pre-order, and it turns out everything they were saying was true. Regardless of your optimism at the time of your purchase. I have to say the person purchasing said pre-order/game is at fault.
Yes we all expect the value of our dollar spent. The problem is you were told what that dollar's value would be, honestly.
How this is different, is that in normal circumstances you're dealing with multi-million dollar companies. You're promised the best thing since sliced bread and more often than not, you're given a sliced muffin, which really isn't much different than bread. At least this time they told you what you'd be buying.
Sure it doesn't excuse the state of their game or their lack of professionalism. in this case I just can't get behind those who are mad they pre-ordered, or say they were overly-hyped leading them to do so.

Please stop trolling. Sorry the game is destined to fail- Thats YOUR problem now.
TJ why you don't contact SV and kindly ask them what is taking so long? They will most likely redirect you to the company which is making the boxes and it has send em out. They will furthermore inform you. Don't be so grumpy, figure things out and then speak.
Also, why do you say 'Sorry the game is destined to fail- Thats YOUR problem now.' It doesn't highlight any of your previous text in anyway, so it's kinda useless to add such pointless sentences in the end. Just do like I said, you'll get over them... your current feelings.

I could agree with you EXCEPT for the fact that none of the info you listed above was part of the pre-order process. If on the pre-order page it outlined everything you just listed I would likely agree (although I still think there would be a case based on time that has passed since they took money and to indefinately hold it and claim "No Refunds" doesn;t seem right). Heck their features tab STILL has stuff that we know wont be in the game at launch and have known so for a long time. They should at least have a disclaimer at the top stating these are future plans and a link to their "basic core" features at launch.

Sorry couldn't quote seems broken (might be FF). Anyway, I completely agree, as I have never viewed their pre-order page. You're right any feature that is only planned should be listed as so.
I'm referring to what were viewed as hot topic statements made by SV, early on when they opened the doors for pre-ordering. I'll correct myself to say anyone aware of these things, I can't feel sorry for. Anyone unaware, maybe I can a little :P.

Completly wrong. You just suddenly understand closed beta wasn't for fun, that's all. Read when you pre order something. Here is what they said you, while preordering, and after:
The launch of Mortal Online is planned for Q1 2010 (Jan-Mar). This is not set in stone however, as we want all core features to be in place and properly tested before charging monthly subscriptions. We do not guarantee a specific release date for Mortal Online.
About the Beta:
Beta testing and gameplay
The Beta is with features from Combat Beta, as well as a few new ones. The very first steps have to do with architecture, back-end and network-performance. To begin with, we are aiming to test:
MO Updater (auto-patching system)
Account System, Login, Logout
Character Creation (The “human family” only, like Tindremenes, Khurites etc, male and female)
General Network and Server stability and speed
Crowd congestion tests
Seamless World-streaming
Updated Prediction System
Sound
Client System Performance
This is not very fun from a gameplay-perspective, although crucial from a technical standpoint. To make you run around in the world and have some feeling of purpose in this crude beginning, we are also testing:
Attribute balancing, basic Skill gain (a few example skills)
Further real time PvP, Melee and Archery Combat testing and balancing
"Vendor-crafting" (you bring resources to a vendor, who then crafts stuff for you according to your instructions, like in Combat Beta). The Skills and GUI (Graphical User Interface) for the "real" crafting is still in development
Very basic resource-gathering (refining, prospecting etc will be in together with crafting later on, meaning at the moment you will get magically pre-refined resources when mining, etc)
Fundamental AI-behavior, a few creatures
World traversing, Swimming and Combat Swimming
Around 32km^2 of the Myrland continent
Basic banking (global at first, local if we manage to get it in before this weekend)
Local chat (no languages)
The Flagging System (complete with temporary insta-guards in guard zones)
That's it. Nothing more, nothing less. These first important steps will be the foundation of the game, and updates will come quickly and at a regular basis once we are confident most of the above is working in the new massive environment.
Please also remember that both your possessions and your Characters can be wiped from the server at any moment, and that this may happen several times during the Beta.
You're in for a rough ride, but we are excited for those of you who want to embark on this journey with us!

I really don't want to fight with you.. so I will just point out to you that the SOURCE you linked was ninja edited by the developers and that date was NOT shown when we ordered. How could they possibly have shown Q1 release during pre-orders in July when it wasn't pushed back to Q1 until they took their Christmas vacation.. in December?
AAlso please note that what my post was responding to is what was supposed to be in the RELEASED game... for some reason you linked a source to what was supposed to be in the July beta... to say I am confused is an understatement. In that document you linked does it say "(in different words) this game would release unfinished, with only the core functionality"?
Because that was what the poster I was replying to was talking about... not.. What will the beta look like on July 14th which is what you linked...
As I said..(again...) if the PRE-ORDER page said "This game would release unfinished, with only the core functionality" the poster would have a point that the burden would fall on those ordering. That information was NOT on the pre-order page as evidenced by you so kindly liinking it for us to read...
So please.. be careful in the future before you blast someone as "totally wrong" and prescribe motives to other people.
