Future Shop Fukked Up!

I went to future shop today, and bought a ATI radeon x800 pro, passed on the x800XT because i can overclock the pro to beyond the performance of the XT anyway.

So, that's 600 bucks for the card +80 bucks for the extra year warranty.

came out to 750bucks

I get home and start installing it, take out my 9800pro, compare the cards and am surprised to notice the x800 is significantly smaller. I think to myself "interesting, they managed to greatly reduce the size in one generation of cards", with absolutely no suspicion(sp?) in my mind.

So i get to installing the video card, and spend about 3 hours trying to figure out where the damn 4 pin power connection is that would go to the power supply, as this card needs to be connected to the computers power supply.

Finally i get really annoyed, reinstall my 9800 pro and look on the internet on installation guide for the x800. First picture i see of the x800, i notice that the card is Red , and mine is green. On top of that there is no picture on my card, and i notice it says the card is 64mb of sd ram (lol this is where i start getting confused). Of course the reality hadn't struck me yet of what had happened, because the video card was perfectly sealed when i took it out of the box, and had never been tampered with as far as i can tell.

Anyway, i took the card in to future shop about an hour ago, and tell them my story. They seem to think i bought a cheap card and this x800, and kept the x800 and put this cheap card into their box and returned it.

While this obviously went through my mind, what can i do but return it? So i sit in the managers office for about 45 minutes while he talks to the tech guy, and on the phone etc.. (obviosly a 600 dollar video card disappearing is a big deal).

Finally he comes back and says he cannot give me a new card. The best they can do is phone ati and see if this is in their records or some crap like that (why the hell would they know about this).

Well, so now i am sitting here with 750 bucks less in my bank account, and nothing to show for it.

Suffice it to say, if they don't fix things tomorrow i don't know what i will do. My side of the story sounds fishy, but i never stole and this is nothing but the fault of either future shop or ATI....

So, any advice as to what i should do would be great. I have reason to be very angry and am, but don't know what i can do other than take the store to court if it gets to that point, but doesn't court cost money? Blah this is frustrating, maybe i will just end up having a huge verbal assault on the store manager and/or beating the shit outta him. Lol that would be great.

Post thoughts or advice please.

    Lawsuit. Threaten them and they will crumble.  But do not just use idle words.  Actually go file a claim at your county courthouse, you may be out another $50, but at least it isn't all of it.  And one word of advice.  Always open it in the store after you buy it and make sure its the product. 

    Another option, and please don't say you paid cash, is to cancel your check or contact your credit card company to put a stop pay in effect.  If you cancel your check, you may want to talk to the county DA and tell him the situation so you do not have a warrant issued for your arrest for writing bogus checks.  If it's your cc company, tell them the story and they usually will post a stop payment. 

    edit: And if you do decide to assault him and beat the shit out of the manager, don't forget to shove the crappy video card right up his ass. image

    Dont take no for an answer ::::27:: even if you have to goto court you stand a good chance of winning, but always always inspect new HW before you leave the shop...

    I've had shops try it on with myself and mates in the past in the US and the UK they are really taking the piss here with you, go get em they will buckle.

    Get 5 mates to stand outside with signs telling how they are trying to rip you off next time you go and see them.... post their email addy here if you have it.... start a petition.

    Finnally some advice that just plain makes sense. I would have forgotten that lat part altogether.  Thanks.  hahahah Next time Im at the drive up teller at the bank and someone cuts in front of me, Ill slowly get out of my car and shove my bagel in his tailpipe.

    well dont give up, if youve truly been screwed over make sure they know this. In the past Future shop generally employed morons and people have been scamming them for years out of computer hardware so they might have gotten tougher of returns.

    I strongly suggest no one buy computer hardware from them, safer to stick with the smaller mom and pop computer stores found all over most towns. I was screwed over by future shop myself years past, bought a voodoo banshee and got an ATI rage pro instead =P i was pretty pissed.

    just get a hacker to bot the hell out of their servers or hack into the comp and get their credit card list and buy a video card online O_O well thats kinda illigal so do the first one

    Fight it. Stores and other companies keep insurance for lawsuits. Granted some people are full of sheet but if your being honest here (and why would you lie) then give it a shot. Many lawsuits get settled merely because it's cheaper then fighting them.

    Do: Consult a lawyer/attorney, stop payment, save your receipt, take notes on ANYTHING you remember from purchasing the card to the realization that it was bunk... this includes who was the sales person/cashier... Where did you look the card up... everything. Detail, detail, detail.

    Don't: Scream and threaten the employees... that is what lawyers are for, only they won't go to jail for it or discredit you.

    Keep in mind that many lawyers for this such think will work for a % of the settlement. Let them LEGALLY pound the card up the store's arse... and btw often in such cases you can tack on money to pay for the lawyer... talk to one about it.

    Man, that's pretty messed up...I don't know what to say... It seems someone at ATI packaging department made a huge mistake. It isn't really the store's fault as you mentioned, it was sealed in the box and untampered. BUT, you still need to take it up with them as you didn't get the product you paid for. You're still in a tough bind though, since you already opened it. It's going to be hard to prove you didn't do a switcheroo.

    Honestly, imagining myself in your position, I would probably make a huge fuss at the store and emotionally convince them that I was robbed of $700+. They might believe you enough to just end the problem asap. Other than that, you would have to seek council with a lawyer, try to reverse the payment if you used a CC, etc. For that amount of $, I'd go all out and take whatever I can.

    I'm curious though, in other threads later than this one, you still claim to be using an x800pro. Did you grab a new one, resolve the situation, or did a switch?

    This is off topic a little concerning what happened to you, but you might want to double check whether or not you can even use a x800.  The only ones I've seen were PCIe, and it sound's like you were trying to plug it into an AGP slot.

    I could be wrong, though.  I just remember looking a few weeks ago and not finding an AGP x800.

    I am playing the game on my sisters computer, she has an x800.. that answers your question and for the next question:

    The x800 was AGP, said so right on the box, and it was shaped exactly like an AGP card, and fit into the agp slot .... , but then again, it wasn' t an x800 Lol... but the box said AGP and the card i got was also AGP...

    there is indeed a version of x800 for AGP. if i were you i would throw a fit in the store, or just stay in the store and annoy them until they give in. i have had problems like this with best buy, i bought a video game, took it home and installed it, and it wouldn't play on my computer (of course it wasn't as much as your card) so i took it back and they said we cant take back opened games. so, i yelled at them until they got the store manager, and after i talked to him about it for a while he returned it and gave me a store credit. im not sure if this would apply to your situation, but i would also recommend going to ATI directly about it and sending them e-mails or mail to thier customer support, maybe calling them if they have a phone number and they may replace your product, also stopping payment if you used a CC may work. as a last resort i would get a free consultation with a lawyer and get his input, and maybe file a lawsuit.
