Bethesda has decided to drop their lawsuit against Interplay over the Fallout license, following an out of court settlement between the two parties. This is a surprise turn of events, given the seemingly bitter battle that has played out between the two companies. The real winners here though are the gamers, as progress towards the completion of the Fallout MMO should now proceed (hopefully) uninterrupted.
Below are some of Interplay investor Frymuchan's comments regarding the issue:
Bethesda dropped their appeal of the lawsuit with Interplay and a secret deal was struck (maybe they will release the terms of the deal soon, probably so). Anyways, this is awesome news for Interplay stock. The appeal by Bethesda was dropped yesterday. I'm assuming part of the deal was that Interplay drop their countersuit against Bethesda.
At any rate, this will likely mean that V13 will be moving full steam ahead, terms of the new deal not yet known but the fact that the game will be made is nothing but good news for Interplay.

UPDATE: Bethesda is now denying reports that the lawsuit has been dropped. Pete Hines' comments to Kotaku below:
"That is still ongoing and has not been resolved. It is a minor procedural thing that took place, not a dropping of the lawsuit."
"The bottom line is it's an ongoing legal matter, it's in no way, shape or form done," Hines continued. "We're going to let the process play out in the courts, which is what we've said all along, but beyond that I can't give specifics as to procedures. That's not my domain."
[Thanks to Mike Fahey over at Kotaku and ABRaquel for the heads up!]

cool cant wait to see what they come up with for the fallout MMO.
Nice, a fallout MMO will be awesome. Hope it watches and learns from fallen earth great game but has a few flaws imo, we need a good apacolypse game.
Currently Playing Path of Exile
I just wished Bethesda was the one making it.
Shame, would have been far better off in Bethesdas hands. It will go no where now.
Yeah dude. It's kind of a buzz kill that bethesda wont be making this game.
What a downer.
Playing: Rift, LotRO

What a downer.
i would rather see the main devs that made the first 2 fallout games than bethesda make this mmo. They at least know what makes a fun and good fallout game.
Personally i thought Fallout 3 was alot of fun.
Uhh.. why? Bethesda is good at making single player games.
Those single player games do not lend themselves AT ALL to MMORPGs. Same reason why Bioware making an MMO doesn't automatically make it good.
WoW great news love Fallout series.
Yeah me too, I just don't think interplay has the stability to create a good and unique MMO, Not to say Bethseda would've gotten the unique part down right but at least they've got the economy to try things.
I'd be very suprised if the Fallout MMO was nothing more then WoW with guns and a post apoc theme :.
If Fallout Online isn't brutal/dynamic and all about survival then it's not going to be Fallout. The perfect Fallout for me would have no safe zones, no banks and demand moral responsiblity versus survival.
Just an example say a group of players have a shanty town and their food supply gets erradiated. Now they know a town( run by other players) near by has food, in a real fallout game they would have to decide do they offer exchange for the food? Or knowing they got the fire power just take it by force?
I just hope they don't have fake crap where I do have that decision and I do it, and then it's like another MMO where it had no impact on the world and then joe/jim and bob can do the same thing and act as if I didn't do it. I want results!
This is fantastic....Fallout 3 is already the perfect system for an MMO....just takes some tweaking, more content, some more skill systems and you have an amazing MMO....fallout 3 included:
Craffting
Skill development/progression
Open world
Quest based system
What would Bethesda do better or different? This MMO is already pretty much done.
Ugh...at some point Devs will look outside the box.
Since when did all an MMO need was to be a good single player game? And that open world is going to fall apart when you add more people. Also quest based system won't work with more players either.
I don't know if those guys are still around.
Playing: Rift, LotRO

I have news for you. Most of those devs are not at Interplay. Tim Cain, producer and designer of Fallout, left after disputes arose from FO2. The last year Interplay published a game was '04. They dismantled their Black Isle studio in '03, because they had no money. There is no way there are any devs left besides Taylor and Anderson, who were recently brought in, because there was no work(and no money to pay them).
I love fallout, I love bethesda. The real question now is... if Fallout isn't in bethesdas hands, do they still have an unannounced MMO? If so....The Elder Scrolls series may see an MMO... thats exciting.
And just how do you know that? Interplay has already been working on Project V13 for a bit and was going nowhere because of this litigation now they can resume work on it and I am pretty sure it is going to go somewhere with Masthead studios also teaming up with Interplay with the development and the use of Earthrises engine.
Man I really hope TES 5 is planned to be released before TES mmo.
I've played both Morrowind and Oblivion over a thousand hours combined i need a new single player game by them.
Playing: Rift, LotRO
Waiting on: GW2, BP
A pure PvP Fallout game would be a Failout. The games were about the PC vs NPC's. Not PvP.
How do you do "good" pvp in a world where people have to sleep/work/school? "Oh look, their town is undefended because they aren't online, lets go destroy it!"
I've seen that game, its called Shadowbane. And it failed. Horribly.
The main criteria for a good game is that it be fun. A Fallout MMO *could* be fun. But a PvP-centric Fallout game would be a tiny niche game at best.
great news for all
Kind of interested to see how earthrise turns out. If it turns out good might mean a fallout MMO would also.
Yeah dude when i think of fallout I dont think of pvp. Same goes for elder scrolls.
I would be happy if they left it out honestly.

Here is a link to some of the news I dug up on the Fallout MMO plus some screenshots and concept art for those who may be interested. And to the news of the dropped lawsuit is good thing for the fans of the series hopefully with the engine they are using we can get a immersive and engaging game hopefully it will be a themepark/sandbox hybrid with the best of both worlds.
Is it gonna be point-and-click like the first two games or an FPS like the 3rd one?
In the hands of bethesda a Fallout MMO could see a lot of potential customers, in the hands of interplay, who is currently renown for such games as Boogerman, I'm sad to say I don't think this game will ever make it to the shelf, and if it does it will be in the bargain bin in 2-3 months, if they're lucky.
Right there is as true as it gets. All these people falling all over their faces trying to kiss Bioware and Bethesdas ass when they haven't done an MMO yet. I do hope they make a good game but if they don't it won't surprise me. Just because you make a good single player game doesn't mean you will an MMO.
How many delicate flowers have you met in Counterstrike?
I got a case of beer and a chainsaw waiting for me at home after work.
