I have just dl'd the HoMM client and read through the terms of the agreement. Everything seemed quite reasonable until I came to (their upper case, not mine)
THE COMPANY DOES NOT WARRANT OR REPRESENT THAT ITS SECURITY PROCEDURES WILL PREVENT THE LOSS OR IMPROPER ACCESS TO YOUR DATA.
The clause gave me the impression that their security procedures are so lax that they can't even try to prevent data loss.
Does this mean that if there is a hack into their systems and their security is too poor to prevent personal data loss that we have no redress? Isn't this against data protection legislation?
I haven't noticed this in other games' terms, but maybe this is becoming more general and I just haven't seen it.

I don't think that it means their security is lax. I think they are doing it to protect themselves from lawyers. As I am sure you know people sue at the drop of a hat.
Look at the warning labels on products. ie. on microwave popcorn "Warning contents maybe hot'. If they did not do that some idiot who got burned would try and sue them.
Sad we have gotten to this point but ambulance chasers (lawyers) are everywhere.
It's pretty normal, it doesn't mean their security isn't good, it's just a way for them to protect themselfs, I would of thought most games have it, especially games like WOW..

Why would they provide a warranty? You expect them to guarantee the security of your data and compensate you if anything happens to it? Nobody will offer that, because there's nothing in it for them except risk. You want to refuse to play any game that doesn't offer a warranty? Well, (a) you won't be playing any online game, and (b) you're one in a million and not worth taking on all that legal risk just to get your few dollars.
