So if you got your refund, you have no more right to QQ and to call the game a sham.
If a person asks for and receives a refund because they are not satisfied with a product/service (for one reason or another), they give up their right to express to others their dissatisfaction? Are you saying that Xsyon is giving refunds as some kind of hush money?
There isn't a "right" or "wrong" way to play, if you want to use a screwdriver to put nails into wood, have at it, simply don't complain when the guy next to you with the hammer is doing it much better and easier. - Allein "Graphics are often supplied by Engines that (some) MMORPG's are built in" - Spuffyre
NCsoft isa big name and look, so you can't count on big names either... Many people got banned and hacked, most of us which where not in game for a few months, and in the end they blame us for being hacked...
I was banned hacked and I was in a hositpol fightingf or my life to come home to play my acount which I didn't even get to play but 5 days after release.... and come to find out my chars which where deleted and my account banned hacked.. someone had played it to make rl money off of, which this happen to over 200k accounts I was told by ncsoft, so some of you are saying buy a game from a known company and you won't be ripped off is a lie...
Sorry to hear that NCSoft hacked your account and deleted your characters. Oh wait...
There's a lot of serious reaching and grasping at straws starting to happen in this thread.

No. I'm saying that if a player who is not satisfied with the game gets his money back, then he can't call that game a sham or a vaporware , since its not. And badmouthing a game and its developers though you got your money back, you lost nothing and they were absolutely correct with you is very very childish, its even incorrect. I can't even understand why would anyone do so, since he hasn't lost anything, so where is that anger coming from ?

Getting your money back for a substandard product does not make it any less substandard. To complain when you feel wronged is not childish or incorrect it's a very, very human thing to do. Especially when there is a real basis for it. It's called sharing the pain. Anger comes from being dissappointed. Again. And again. And again. Now if someone does this to excess yes you might have a point but parting shots are part of the experience. For most people it's the beginning of the process of moving on. There is also the accountability aspect. People need to be reminded that this state of affairs isn't in any way rare.
The game cannot be judged yet since its not released. All people can complain about is the delay of the launch. Sharing someone's pain with totally strangers through the net...oh well...isn't it childish ? Every adult person should know that preordering a game means taking risk, risk of the delay of the launch and the risk of not liking the game. If someone is not willing to take this risk, if he is unable to deal with the disappointment he shouldn't preorder at all. And about the accountability, noone has lost anything, every player gets his money back if they wish so, so noone got ripped off, cheated, fooled or anything.
So if you got your refund, you have no more right to QQ and to call the game a sham.

The game cannot be judged yet since its not released, however that's not the complaint most have so it's reasonable for people to be upset the product they already paid for and were given a solid release date was not released. All people can complain about is the delay of the launch... and that they are now being asked to beta test... and that the claims of content being finished appear to be false... for the product they paid for. Sharing someone's pain with totally strangers through the net is part of 21st century culture on this planet. Every adult person should know that preordering a game means taking risk, risk of the delay of the launch and the risk of not liking the game, however this isn't a caseof not liking the game rather a case of the developers not delivering on promised dates and content.

If some people who preordered aren't willing to wait till the game launches, thats fine, ask for a refund and leave.
A lot of people are willing to wait, they won't test just keep their eyes on the game and will come back when its ready to launch.
Another bunch of people are happy to help and test, they are actually enjoying the game already, they don't feel ripped off or cheated in any way.
What I don't get is why some people like to badmouth a game instead of asking their money back and leave it alone ? The ones who don't want their money back are free to make their decision, noone has to save them from themselves. Xsyon developers are very correct about money, as far as I know everyone who asked for refund till now got his money back, though when you preorder the game you accept ToS, and its stated in there that once you accept the ToS you are no longer eligible for a refund. Still they do give people's money back if someone wishes so.
So if you got your refund, you have no more right to QQ and to call the game a sham. If you didn't ask for refund, that means you are willing to wait, so why you keep QQing ? If you didn't even preorder then again you have no reason to badmouth the game. Only a person who preordered, got upset with the delay ( I could understand that), asked for refund but didn't get his money back has the right to complain (if we forget about the ToS).
Whether they got a refund or not is irrelevant. i'm glad they were able to with minimum fuss, but this issue--once again--has nothing to do with being "happy to help and test":
You shouldn't have to pay for the right to help and test.
You weren't asked to help and test - you were sold a product that was allegedly complete enough to launch on April 15h, 2010. Given what we know now, it's clear that was impossible. The game was obviously not a in a state that it ever could possibly have launched on April 15th.
So what is the issue really about? Poor, even possibly fraudulent business and marketing practices. It needs to be discussed, because without discussion and exposure, these types of practices will continue. In many cases, positive change doesn't occur until dirty laundry is aired..
Btw - players defending indie companies and excusing their practices need to realize that Indie <> unprofessional. Perhaps the most recently successful indie company is Kingsisle, Inc, with their smash hit Wizard101. It's a wildly successful, fun, polished and surprisingly deep game (considering it's a kids game that appeals greatly to many adults) that doesn't have a major publisher, but is run by knowledgeable, professional industry veterans. Does it matter what type of game it is compared to Xsyon? No. Indie = indie.

I think you missed the point of my post. I didn't say people cannot blame Notorious Games for very bad marketing. Actually they can, it was a huge mistake to advertise this game as a one which is ready to launch in April. But still the game isn't a scam or a sham, since they didn't do that to scam you out of your money. Its beyond my understanding that how could they think this game would be ready to launch in April, but they did. If they have wanted to get people's money by false advertisement it would have been logical to advert and hype the game as much as they could. But on the official forum they asked players not to hype the game, not to post about it on other forums, not to call people to join. And now when some people are unhappy with the current state of the game (which is understandable) they are giving back the money to everyone who asks for it. Thats a very correct business behaviour, and a rare one too. All these things show that they had no intention to scam anyone. The game isn't in the state we all hoped for, but thats not a reason to call the company a scammer.

But its not about bad marketing.
The thread title is not vaporware, but definitely a sham. A sham is not the same as a scam.
A sham is cheap falseness or a trick that deludes.
Xsyon practiced intentional or unintentional trickery, whether it was intentional or not, we do not know, or at least I dont. What we do know is that its not just about marketing, but bad behavior that has become too prevalent. Its shows lack of professionalism, accountability and leadership.
On their “public” forums in February or March, in conjunction with promoting pre-orders for early access for a 4/15 launch publically, Xsyon did not ask or warn people not to talk about their game publicly or socially mention their project publicly with people; Xsyon did it publically.
Xsyon told the community approximately 2 months before the original (April) release date that every feature on the feature list is either 100% complete, or 80% complete".
Xsyon told the community that the “servers have been stress tested and should support the size of community without problems.”
Xsyon to the public community about the numbers their looking for …. “I'm guessing about 500 before April 15th, building slowly to around 5000 active players by the end of summer.”
The unepected server problems are what have set the game back so far. if it wasn't for them it would be a whole diffrent story. One cannot for see all problems that may arise.
I fail to see the differance in Xsyon saying they are releasing in a few months and then push the date back and every other company that has done the same thing.
I don’t see what the big deal is. They delayed a few months because the server wasn’t as good as they thought. Yeah most of the features are missing from game but that doesn’t mean they are not 80-100% as claimed, just means they are not in yet.
Judging the game before it is complete is silly. I guess complaining because of a few month delay is valid but burning the Devs at the stake for it is a bit much. Delays in software development happen, especially in the indie game market. Calling this game a sham (something that is presented as genuine but that is not) because a small setback is not justified. Six months, a year from now then I would agree… Thinking MO.

It sounds like the real split here is between people who beleive that the 80-100% thing is true and the ones that don't. It's been relatively consistent in these threads that the ones who believe that claim don't have issue with the situation, whereas the ones who are experiencing an ingame situation that is indicating to them this might be a false claim feel misled.

If you give them a reason and Xsyon and their devs game more then one. So they and you dont have to wonder about it.

Actually, this is just a classic case of history repeating itself. Darkfall was delayed numerous times due to the same issues and so was Mortal Online. The reoccurring theme here is to LEARN from other companies' mistakes, not copy them. This is what should have happened:
1) Hire beta testers, not "preorder" testers.
2) Perform extensive debugging/testing with each promised feature in said program/game.
3) Whenever each feature has been extensively tested, start a "controlled" open beta, allowing so many players in at a time until problems arise with load on server. Continue polishing/debugging/testing to minimize load on server without compromise of set features. Allow more into server until desired amount is reached.
4) During all of this time, make sure you are communicating with the playerbase on what's going on, what's being tested, status etc. During open beta, open up preorders. I like the pricepoint of this game, so I'll use that as an example.
5) For those who preordered, for example this game, allow those players to be granted *early access* to terraform the world. The rest I like regarding to how the problem is being approached.
Honestly, I'm really getting tired with companies that promise so much, yet never deliver on said promises. Xsyon, while I wish for you to grow and prosper, I will not be there to help terraform the world. I refuse to be possibly burned again, as I was with Warhammer, Darkfall, and Mortal Online. I will not be led astray again.
If you want to set yourself apart, then don't copy the big companies, and certainly don't use the "everybody else is doing argument." That certainly won't encourage people to buy your product, if anything it will make people wary, which will result in fewer subs and box sales if you decide to release in stores as well. All I can say, is if you aren't %100 positive about something, don't promise it to the playerbase. Seriously, how hard is this to understand? I don't care if you didn't anticipate this or that, those potential, unexpected problems should have been worked out a LONG time ago, BEFORE opening preorders and obtaining money for a product that is still in early development.
I'm disappointed that YET AGAIN another Indie company profits on the ignorance of a starved niche.
Personally, I read alot before I preordered. The game was in the exact state that the developers on forum stated. I am looking forward to the new server that is goign to be up early next week. I have had alot of fun goofing aroudn in game. untill release I can keep goofing around for 4 5 months in the game. I don't get why people join games that dont have many features activated yet and then cry about it. I Personally, as a programer have alway enjoyed seeing other companies work in this stage. You can learn alot.

At one point, when preorders were initially offered, but before they were allowed in game, did the developers give the exact state the game is in? Is it when Virtus said all features were at least 80% complete? Is it when they initially offered preorders and said the game would launch to the general public on April 15th?
I think not.
If you've preordered after all this, I agree - the devs have been very communicative, which is a good thing. Anybody who orders now should have a pretty clear idea what they're getting into. For the original pre-orders (pre-ordering was supposed to be turned off after April 14th, btw), no, that is not the case. It's clear the game wasn't close to ready for a April 15h launch, the servers hadn't been adequately stress tested and the game hadn't been adequately play tested. That's what they're upset about and they have a right to be upset, whether they were naive enough to preorder a game for which no actual screenshots or videos existed, or not.
I will never understand why people keep falling for this stuff.. You are paying to beta a test game.. last I checked beta tests were supposed to be free because you are giving your time to test their game for free. If anyone should be getting paid its the testers and not the half truth devs.
In no time the forums are flooded with negative opinions about "one of the most anticipated games" according to mmorpg.com. Well what is with the high hype then? If that game is a scam i suppose that this site can be taken under responsibility for over-hyping a scam. Anyway just remove the game from the most anticipated once or just lower it's hype somehow. Haven't read anything good inhere but still the hype stays.
I wouldn't say that MMORPG.com is supporting a scam by allowing developers to post their game on a blog dedicated to their type of gaming. As for advertising, holding MMORPG.com accountable for shitty games is like holding NBC accountable for douche-bags wearing Snuggies

There isn't a "right" or "wrong" way to play, if you want to use a screwdriver to put nails into wood, have at it, simply don't complain when the guy next to you with the hammer is doing it much better and easier. - Allein

Idk it just seem's to me people like to bitch lol.
If you give them a reason and Xsyon and their devs game more then one. So they and you dont have to wonder about it.

We're playing it and enjoying it. Early stages with good devs who are listening to the client base.
It is a lot more than I can say about Darkfall or AION or the countless other games we've played.
Reincarnation SG Darfall NA1
Will be updated later.
That's what they're upset about and they have a right to be upset, whether they were naive enough to preorder a game for which no actual screenshots or videos existed, or not.

actually rhinok, stress is not a problem at all.
I will never understand why people keep falling for this stuff.. You are paying to beta a test game.. last I checked beta tests were supposed to be free because you are giving your time to test their game for free. If anyone should be getting paid its the testers and not the half truth devs.
I wouldn't say that MMORPG.com is supporting a scam by allowing developers to post their game on a blog dedicated to their type of gaming. As for advertising, holding MMORPG.com accountable for shitty games is like holding NBC accountable for douche-bags wearing Snuggies
