No, SOE holds the property of ALL the work they did for Lucas Arts. Meaning, the Server & the client are co-owned by SOE, however the IP itself is owned by Lucas Arts.
Meaning, that SOE OWNS the server & client software for SWG, but they CANNOT operate it for profit without consent from LucasArts due to IP agreements & copyright.
Unless SOE will "relinquish" the rights to both softwares for a price there will be no SWG anymore. That being said, EA-Bioware could EASILY begin work on remaking SWG from the ground up. However, that would be such a silly thing for them to do considering it's not a viable investment anymore unless they could bring SWG back to perfection pre-CU without bugs & more content.

hmm...I was going to say, where did you get the impression that TOR "sucks that bad".
From these forums? Not the greatest indicator of player satisfaction, if they were WOW would have closed its doors some time ago.
But no, if you really wanted SWG reborn you need someone with more sandbox style experience, CCP might be a decent choice except they are a bit overextended right now.

Maybe because T OR already has far more players and probably has sold more boxes than SWG did in its entire history.
