Nintendo is VERY protective of their IP's, Pokemon especially. Fact of the matter is, they don't want anyone getting their grubby hands on their characters besides those that they choose (read: Developers).
Big companies like Bethesda (biggest one I can think of right now) are all for the modding communities and others using their IP, so long as it's not for profit.
I do like the fact that Toei gave the OK for this to happen, I think it'll be a good indicator of how many fans they really do have here in the states.
