Was it a mistake to release an unfinished title score? Probably but the news that Soule was working on EQN was the bigger news IMO and why they revealed it at Live. It was indeed a weird stage moment and it seems that even Smed was confused on what played by the look on his face. Soule looked way too nervous which may have been being in front of so many people or knowing that what was about to play was not expected.
I absolutely love the EQ/EQ2 themes and I hope the EQN theme has more tones from the first two in by the time it's official.
I think so.
To my original assertion, I'd say SOE didn't renew the contract with Verant Interactive, who owns the original EQ theme.
Verant got swalled by SOE, sure sure .. but when Verant started, they couldn't afford to buy songs, so they likely licensed the songs (Verant was a startup company as a project by SOE employees! .. no funding!) to a third party.
When SOE took control of Verant, they also got access to info on the licenses, with no guarantee of obtaining them. The holders of the music contract (Verant license holders) could be asking a HUGE amount, which SOE isn't willing to pay, for example, as a reason why there is no EQ music in EQN.
EQN is a pretty big title, so I'm sure the music rights are also big (and expensive to whoever sells /buys them).
It's not unreasonable to think this.
Assuming all this is true, which I don't only because the theme was used in 'EverCracked' a few years ago, here's what would seem unreasonable to me:
Would it really be more expensive to get the EQ theme from a license holder than hire Jeremy Soule?
I would argue that he's the highest priced composer of video game soundtracks out there right now. That fact alone leans me towards SoE having Soule produce what we heard as being their choice alone. Hopefully they add some EQ flare to it.

Or a combination. Soule was hired awhile ago, whereas the EQ theme contract is ongoing.
If SOE had the theme locked down .. damn if they wouldn't play it .. I mean they have SOE / old-school EQ fans watching their livestream. If they could they would. I think it would have made a more powerful lasting moment if some semblance of an EQ theme was played.
But Soule played dreamy music with a horn in the background, with no particular theme at all. Is this a song you would hum at work? probably not.. it's not a theme, it's not everquest.... it's background music for science shows I watch on cable. I hear that stuff often .. and I bet those composers get paid less (but they are equally as valuable as Soule).

It was obviousy rushed for Live to announce Soule's involvement and I'm not so sure when Soule was hired. I'm not going to say what you're proposing is wrong because I don't have that inside information. Seems like a stretch though.

SOE owns the rights to the music for all the Everquest games.
Everquest started development around 1996 under Smedley when the division was named Sony Interactive Studios America ...at the beginning of 98 Sony formed the group SOE, while Sony Interactive Studios America was renamed 989 Studios, but by the middle of that year the studio changed focus to console games, while the PC group spun off under the name RedEye Interactive which was then changed to Verant Interactive. Even though Verant was a "seperate" company they were really nothing more than an out of house development team working on Everquest for Sony.
The original theme for Everquest was created by Jay Barbeau when he was an employee of Sony Interactive.

1st thing i all ways do is mute the music in a game, so i matters to me not at all.

EQ RAP.
I need a beer and a cool tune now.
I think they should and the opening screen would be Firiona Vie with a sideways baseball cap and oversized clock necklace

I like the new theme, they said they wanted to do something different. I get it stuck in my head every time. It actually has a really great melody.
