The game is almost completely open world PVP. Land and water. Not sure about air... YET.
You CAN kill members of your own faction. If you're witnessed murdering people I believe you might go on trial with a panel of player judges and you can even get sent to a prison from which I assume you must escape.
There are few 'safe' zones, but PVP is definitely a big part of the game.
If you kill enough people, you could become flagged as a pirate... in which case you're pretty much not welcome anywhere by anyone except other pirates on an island. Hope that helped
